Would-Be Thief at Wawa

What started as an apparent innocent attempt to buy cigarettes ended with police searching for a would-be robber who investigators say tried to empty the register at a local Wawa store.

Philadelphia Police released surveillance video Tuesday that shows a man wearing a green hoodie and black coat entering the Wawa store located at 6400 Torresdale Ave. in the Tacony section of Northeast Philadelphia in the early hours of Jan. 8.

According to police the man asked the employee behind the counter for a pack of cigarettes. As the two talked the suspect said “give me all the money in the register.”

The employee never opened the register during the short exchange. You see the man look around and leave the store after he was scared off by a customer entering the store.

He wound up making off with nothing and never threatened the employee, according to investigators.

You then see the suspect -- believed to be a thin man in his early 30s standing about 6-foot-2inches tall -- quickly leave the store and run off northbound on Torresdale Avenue.

This is one of a recent string of hold-ups and attempted thefts at Wawas in the area of Northeast Philly. A reward has been offered for information leading to a masked man believed responsible for some of those heists.

Anyone with information or who recognizes the suspect is asked to contact Philly Police.

Fire Escape Victim Hires Lawyers

The third person severely hurt after falling more than 40 feet to the ground when a fire escape broke off a Rittenhouse Square apartment building has hired high-profile attorneys to investigate the collapse.

Nancy Chen suffered multiple fractures and remains hospitalized after the fourth-floor fire escape she and two others were standing on collapsed on Jan. 12.

The 22-year-old public programs manager was attending a party at the John C. Bell apartment building in Rittenhouse Square and had been standing on the fire escape landing with two others -- Laura O'Brien and Albert Suh.

Both Chen and O'Brien suffered severe fractures. Suh was killed.

Chen hired attorneys Robert Mongeluzzi and Andrew Duffy to represent her as the investigation continues into what happened.

"Properly maintained and adequately inspected fire escapes simply do not collapse and kill people," Mongeluzzi said in a statement. He is representing victims in the Center City building collapse. "A fire escape, a critical life safety building feature, must be able to safely hold the weight of all foreseeable occupants. This fire escape failed miserably."

City officials said the fire escape had not been inspected by licenses & inspections officials in more than 50 years. Law only required the escape to be reviewed after installation.

An L&I inspection following the collapse found the entire fire tower to be imminently dangerous.

Chen's announcement comes a day after O'Brien and Suh's family filed a lawsuit in the case. They claim the building's owner The Khoramm Group failed to properly maintain the fire escape, which they allege was deficient.

NBC10 has been unable to reach the building's owners for comment.

When California pharmacist Kevin Kingma received a letter last fall notifying him that his high-deductible health plan was being canceled because of the Affordable Care Act, he logged into his state's health insurance exchange and chose another plan beginning Jan. 1.

Thanks to a subsidy, Kingma's monthly premium went down, from about $300 to $175, and his benefits improved.

But this month, Kingma logged into his bank's website and saw that his old insurer, Anthem Blue Cross, had deducted $587.40 from his account and had enrolled him in another of its insurance products for this year -- he says without permission.

Hundreds of other consumers are caught in the same predicament, insurers acknowledge. And the California Department of Insurance said it is exploring whether any laws were broken when insurance companies withdrew money from consumers' accounts for plans they didn't select.

Here's what happened to Kingma and others: When they received letters last fall, they were informed that their plans had been canceled. But within the letter, it also said that if they did nothing, they would be switched over to a different plan and if they had set up their payment to autodraft from their account, it would continue to do so.

Kingma said he didn't read the whole letter, just enough of it to know his old plan was being canceled.

Once he noticed the withdrawals from his account this month, Kingma said he tried calling Anthem's customer service hotline but couldn't reach anyone because of "high call volume." Dozens of consumers have reported long phone waits trying to reach Anthem.

Kingma then repeatedly faxed and contacted the insurer through its website. An Anthem representative first told him that he may only receive reimbursement for about half of January, until the date he actually canceled the new policy. Since then, it appears the insurer canceled his policy at the end of 2013. But as of Friday afternoon, it hadn't refunded Kingma's money, he said.

"I and a number of other former Anthem policy holders are stuck in Anthem's Kafkaesque nightmare as part of healthcare reform," Kingma, 57, wrote to me in an email.

Darrel Ng, a spokesman for Anthem Blue Cross, said in an email that insurers across California had moved members from canceled plans to new ones that comply with the law "and that transition retained their payment preference.

"In cases where members neglected to inform insurers that they had selected a new plan or informed insurers too late that they had selected a new plan, members are receiving a full refund for any amount paid."

Kaiser Permanente spokesman Chris Stenrud confirmed that his insurer has also found cases similar to Kingma's.

"Unfortunately, about 500 of our existing members in California who had automatic payment set up for their current plans were inadvertently charged before our systems recognized their enrollment in new plans through Covered California," the state's exchange, he wrote in an email. "We have identified the affected members and are in the process of contacting them to make them aware of the mistake, and of course, our commitment to refund the extra charge.

"We take this seriously, and want to assure our members that we will make them whole," he wrote.  

These actions may not fully satisfy the California Department of Insurance. Janice Rocco, deputy commissioner for health policy and reform, wrote in an email that insurers have cooperated with her agency and refunded premiums when questions arose, so "we hadn't been focused on what the potential legal violations might be."

She said insurers may have violated the law in two ways by deducting funds from customers' bank accounts electronically. "Moving a policyholder from one product to another would be considered a 2018material change' that would trigger a requirement in law to provide information about how to cancel the electronic funds transfer agreement. We did not see any notice of how to cancel an electronic transfer of funds in the policy cancellation notices, so there may be some violations of law in this regard." 

Beyond that, Rocco said, some of the new products used by two health insurers were technically "sold by one of the insurer's affiliated companies with which that policyholder had no prior electronic funds transfer agreement, so that might be another area of potential legal violations," she wrote.

It isn't known whether similar complaints have been lodged outside of California. But insurers in a number of states sent consumers letters saying they would be moved to new plans unless they said otherwise. (This letter was posted online by Politifact.) The Associated Press reported last month that at least 4.7 million people were told their old health plans were going away because they didn't meet the coverage standards of the Affordable Care Act.

Kingma said the whole situation has left him frustrated.

"No business conducts fair business that way," he said in an interview. "In December, they should be telling customers, this is the plan you will be converted into, this is the cost. I don't put anything past large corporations."

Heating Oil Truck Stolen

A tanker truck filled with home heating oil was stolen off of a Philadelphia street as the area deals with some of the coldest temperatures of the season.

Philadelphia Police say a blue Mama’s Boy Heating Oil company truck was stolen from 58th Street and Whitby Avenue in Southwest Philadelphia sometime overnight.

Chris Thomas, the delivery company's owner, says he had left the truck parked outside at the location because he was having trouble with the brakes.

“So you got ice inside the air brake lines causing the air not to go through,” Thomas said. “So there’s an air shortage which means if I drive the truck with that much weight and if I can’t brake I would be in jail. You’d be interviewing a guy who couldn’t brake and killed some people.”

Thomas says the truck was filled with 3,000 gallons of fuel when it was taken -- worth nearly $13,000. Thomas told NBC10 exactly what he was thinking the moment he realized it was stolen.

"Honestly? What the -" he said. "They took my livelihood today. That was our main truck there. Whoever took it, knows about oil."

Thomas also believes that the culprit was following him prior to the theft.

“This is not no terroristic thing,” he said. “The average price right now wholesale is about $4 a gallon. So it was about almost 3,000 gallons on the truck so you do the math. It’s a hot commodity.” 

The theft took place as the city deals with arctic temperatures and sub-zero wind chills.

The truck has “Mama’s Boy” written on the doors of the cab, but does not have writing on the tank.

Police are asking anyone who may have seen the theft or noticed the truck to call them.

The Philadelphia region saw a series of positive trends in the residential market last year with boosts in sales and prices and a decline in inventory and days a home lingered on the market before being sold.

This is consistent with national trends. See story here.

For the overall region, the number of sales rose by 14.5 percent last year, according to the latest HomeExpert Market Report conducted by Berkshire Hathaway HomeServices Fox & Roach. Year-end median home sale prices nudged up by 2.4 percent to $210,000. Chester County posted the highest median sale price of $297,000, which is a 4.2 percent increase from 2012, followed by Bucks County at $269,900, which is a 3.8 percent increase, and followed by Montgomery County at $255,000, which was a 4.1 percent rise. The retailer devoted to home-and-office organization will open March 8 at 630 W. Dekalb Pike in King of Prussia.

The Container Store Group Inc. (NYSE: TCS) is based in Coppell, Texas, in suburban Dallas. With King of Prussia, it will have 64 stores. Its only other area store is in Cherry Hill, N.J.

Traffic Court Scandal Plea

A man described as the conduit through which Philadelphia Traffic Court judges passed political favors in a wide-ranging ticket-fixing scheme pleaded guilty Monday to federal corruption charges.
William Hird, the court's retired director of records, told U.S. District Judge Robert F. Kelly that he routinely sought special attention for cases involving individuals who were with the right union, or carried the right political ties.

Often under the direction of his boss, Administrative Judge Fortunato Perri Sr., Hird sent traffic citations to other magistrates for "consideration," a term prosecutors say he used as code when seeking ticket dismissals or a reduction in fines.

His is the fourth conviction in a case that led to federal charges against six Traffic Court judges and prompted state lawmakers to shut down the court last year. Its duties are now handled by a newly created traffic division of Municipal Court.

Hird, 68, declined to comment Monday. His lawyer, Gregory Pagano, stressed that much of what his client did happened under the direction of others. Hird has made no agreement to cooperate with prosecutors.

"It should be noted that he never profited financially or otherwise from his crimes," said Pagano.

Authorities have not alleged that Hird gained any benefit from his role in the scheme, though his boss, Perri, received free auto-repair and landscaping services, and home improvements for fixing tickets for various contractors.

According to the grand jury indictment, unsealed last year, Hird, a former carpet layer and tavern owner, was the linchpin for the court's systemic corruption.

From 1997 to 2001, he worked as Perri's personal assistant before receiving a promotion to court administrator - a position he held until his retirement in 2011.

For much of that time he doled out Perri's largesse, ensuring his boss' friends - including ward leaders, contractors, and a strip-club landlord - had their tickets farmed out to favorable judges.

Though not mentioned in court filings or during Monday's hearing, Hird is also alleged to have played a role in a ticket fixed for Pennsylvania Supreme Court Justice Seamus McCaffery's wife.

William G. Chadwick, who investigated the affair for the Supreme Court, said Hird helped shepherd McCaffery's wife, lawyer Lise Rapaport, through Traffic Court as she fought a wrong-way driving citation in 2010.

Chadwick's report alleges that McCaffery called Hird before his wife's hearing and summoned Hird with a text message when he and his wife arrived. The court supervisor met them at the door. Once inside, then-Judge H. Warren Hogeland dismissed the ticket.

McCaffery has said he had no knowledge of Hird's role as a ticket-fixer and only contacted the court to suggest a judge from outside of Philadelphia hear his wife's case because of his high-profile political position.

Both Hogeland and Perri pleaded guilty last year. Hogeland died months later from complications that developed during heart surgery.

Hird faces up to 315 years in prison and $4.5 million in fines at a sentencing hearing scheduled for April.

Closer to Baldness Cure?

Local medical researchers say they are a step closer to finding a cure for one of the most common cosmetic plights – baldness.

A team of researchers at the University of Pennsylvania’s Perelman School of Medicine say they successfully converted adult cells into stem cells that regrew human skin cells, hair follicles and a hair shaft. That’s a first, according to researchers.

As part of the process, the team led by Professor George Xu implanted the converted stem cells, called epithelial stem cells, onto mice. Those cells, when grafted onto the mice, grew the human skin and the hair follicles, which researchers say were "structurally similar to human hair."

The professor, who credits his team of four researchers and other collaborators across the university with helping to make the breakthrough, says before this new method, doctors were able to produce only a limited number of the epithelial stem cells.

"We’re for the first time able to make an unlimited amount of epithelial stem cells," Xu said, which better facilitates hair regrowth. "The cells we use are from the same patient. We can just take some skin that we can make into stem cells."

Baldness affects half of all men by the time they turn 50-years-old, Xu says. As many as 30 million American women also suffer from hair loss. In 2012, an estimated $1.9 billion was spent worldwide on hair restoration, according to the International Society of Hair Restoration Surgery.

While the results are encouraging, the researchers say there are still hurdles to overcome before the process can be tested on humans and before baldness can be reversed.

There are two parts to regenerating human hair, according to Xu. The first is developing the outer structures with the epithelial cells. Next is a second set of cells, called dermal papillae cells, which assist in facilitating growth.

"So far, we cannot make the dermal part. And we’re working on it," Xu said.

Xu hopes that in the next five to 10 years, his team will be able to unlock the creation of dermal papillae stem cells and then provide a viable way to regenerate a person’s own hair.

“The hope is to make these personalized hair follicles in a research lab and then we will implant them into the patient,” Xu says.

While the research has been focused on regenerating hair growth, the methods also have the potential to help in other areas of the medical world. Xu says the methods his team is developing  could help with healing wounds and burns as well as fixing cosmetic issues in people.

The main broke Monday afternoon between Blair Mill Road and Sycamore Avenue in Upper Moreland Township. A lane was closed on Tuesday as crews worked on repairs.

Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. SEPTA Passengers Stranded

Passengers on a SEPTA train were left stranded in the cold for about an hour after the train broke down.

A SEPTA train heading from Philadelphia to Trenton stopped around 5 p.m. at the Holmesburg station due to a power problem, according to SEPTA officials.

"We waited inside the train for almost an hour before the conductor asked us to get off the train," said Zachary Steinbrunn, one of the passengers. "He stated they had another train behind us and that they would back the train we were on out of the Holmesburg junction station and the other train would pull in."

The passengers were taken off the train at 6:13 p.m. and had to stay out in the cold as SEPTA officials worked to fix the problem.

"We waited over an hour in the cold with no information from the conductors on the status," Steinbrunn said.

Three trains that were following the broken train had to turn around and head back to Center City, causing further delays, according to AMTRAK officials.

At 7:17 p.m., the passengers were picked up by another train and continued towards Trenton. The broken down train was also moved from the tracks.

"The conductor on board said that they stopped outside of North Philadelphia station and switched tracks to make it over to us," Steinbrunn said. "He said they passed 2 other trains on their way to pick us up. We made it home without further incident."

SEPTA officials have not yet revealed what caused the train to break down.

Delivery Man Shot, Robbed

A delivery man is fighting for his life after police say gunmen lured him to a home and then shot and robbed him.

Police say the victim, a delivery man for Panda Carry, an Oxford Circle Chinese restaurant, was called to a vacant home on the 6200 block of Kindred Street in Northeast Philadelphia around 7:40 p.m. When he arrived in his car, he was met by three men who robbed him. During the robbery, police say one of the men pulled out a shotgun and shot the victim in the chest.

The suspects then fled the scene. Investigators have not revealed how much money the suspects stole.

The unidentified deliveryman, who police say is in his 40's or 50's, was taken to Einstein Hospital where he is currently in critical condition. He is now undergoing surgery.

"These delivery type robberies occur often and they're very important to us," said Philadelphia Police Chief Inspector Scott Small. "Especially when the robbery results in a shooting."

Police say the suspects were wearing dark clothing but have not yet released a physical description.

Piece of 25th Street Bridge Falls on Street

Less than a week after a Philadelphia councilman raised concerns about deteriorating bridges in the city, a piece of concrete from a bridge in the Grays Ferry section was found on the street.

A passerby snapped a picture of a large piece of the 25th Street Bridge that had fallen on 25th Street and Washington Avenue. Thomas Mosher, a spokesman for city councilman Kenyatta Johnson, sent the photo to NBC10.

“Following up on the press tour we had last week, we've just been informed that a large piece of the 25th Street Bridge we brought you all to last week has fallen,” Mosher said. “The Councilman is adamant that CSX must come and address the concerns of the people of Philadelphia.”

CSX, the company responsible for the safety of the bridge, sent crews to remove the concrete from the street Tuesday afternoon.

"The piece was identified in a routine inspection and crews and equipment were brought in today to take it down," said a CSX spokesman.  "Crews will now replace the section that was taken down.  The work was done safely and by plan, with the area underneath secured."

Armand Salloum, who owns a business along 25th Street, says he's been clearing falling debris from the bridge for the past three decades. He also claims the conditions have only worsened in recent years.

"Everybody who sees this bridge is always afraid of it," Salloum said. "Our customers come by and they say, 'Oh my God.'"

Salloum fears that someone could eventually lose their life if the deterioration continues.

"This is concrete we're dealing with," Salloum said. "It just takes a chunk this big to go through a windshield and you're done." 

Last Thursday, Councilman Johnson, who serves as the chair of the Committee on Transportation and Public Utilities, held a press tour of the 25th Street Bridge. He also demanded answers from CSX regarding a train derailment that occurred earlier in the month.

Back on January 20, a train derailed near the Schuylkill Expressway (I-76), between South and 34th Streets. According to CSX spokesman Gary Sease, the 101-car freight train was headed from Chicago to Philadelphia when seven cars derailed on the Schuylkill Arsenal Railroad Bridge where it crosses over the Schuylkill Expressway and River from University City to Grays Ferry -- just south of the South Street Bridge. No injuries were reported but CSX officials still have not yet revealed the cause.

“I’ve had concerns about the state of our bridges and other vital infrastructure for a while now,” Johnson said. “I have contacted CSX numerous times with the concerns and complaints that have been brought to my attention by people of the 2nd Councilmanic District and others.”

NBC10 spoke with Johnson again after Tuesday's incident.

"We want CSX to be held accountable to how they maintain their bridges and their railways," he said. "More importantly, what's their plan? So we can stop further issues like this from happening in the future."

A CSX spokesman claims that the company has kept in touch with Johnson and his office.

"CSX has been in communication with Councilman's Johnson's office, and we understand his concerns and those of his constituents regarding the concrete," the spokesman said. "While the bridge is regularly inspected and structurally safe for train movements, we will work to better address these concerns."

Salloum isn't buying it however and says he's complained about the bridge before but that little has been done.

"It's never fun," he said. "They're never very responsive."

Johnson says he and representatives from CSX will have a conference call Wednesday afternoon.
