Del. Man Appears in Court for Charge He Threw Bottle at Ryan Howard

A Delaware man accused of throwing a beer bottle at Phillies first baseman Ryan Howard after a June 4 game appeared in Philadelphia court to face a disorderly conduct charge on Tuesday.

Sidney Smith, 21, of Wilmington, opted in front of a trial commissioner to enter a summary-offense diversionary program that will require him to take a three-hour Saturday class in July and pay a fine of $200. After Smith takes the class and pays the fee, the commissioner told him, his record will be expunged.

Smith faces a disorderly conduct charge in the bottle-throwing incident and surrendered to police to receive his citation on Monday. His photo circulated around the Internet in the days after the incident as police and Phillies fans tried to identify him.

Though the aluminum beer bottle didn't strike Howard -- it landed near his feet -- the Phillies $25 million star player who's been struggling this season was none too pleased with the incident, telling CSNPhilly, "That stuff infuriates me. You want to yell stuff, that's fine. When you start throwing stuff ... The minute it gets physical, it gets personal. That's the way I look at it."

Smith, dressed in a purple striped button-down shirt and khakis, was demure as he appeared in court along with about a dozen others facing unrelated summary offense charges.

"Am I eligible for the third option?" he asked the commissioner quietly, referring to the diversion program she detailed earlier in the hearing. "I'd like to proceed with that."

A man and woman who appeared to be his parents accompanied Smith to court. Smith declined to speak as he left the Criminal Justice Center. The woman with him stopped momentarily to tell reporters, "Nobody knows the real story," but declined to elaborate.

"It was all lies on the TV," she said.

Smith is set to take his diversion class in early July.

Police are searching for a man who they say impersonated a firefighter and then stole money from a Philadelphia Popeyes Chicken restaurant.

The unidentified man walked into the Popeyes on 314 West Lehigh Avenue back on June 10 at 6 p.m., according to investigators. The man allegedly told the manager he was a fireman from Ladder 1 and had to change out the restaurant’s fire extinguishers. Police say the manager got approval from the general manager and the suspect was granted permission to update the extinguishers.

The suspect then gave the manager two invoices for a total of $476 and received the money, according to investigators. The suspect told the manager he had to get tools from his vehicles, police said. He then allegedly left the restaurant and never returned.

Police released surveillance video of the suspect. He’s described as a stocky man standing 5-foot-10 in his mid-40s. He was last seen wearing a black polo shirt and faded blue jeans.

If you have any information on the suspect, please call 215-686-8477.

A fire at a Montgomery County uniform company burned out of control for hours Wednesday morning.

The two-alarm blaze broke out after 11 p.m. at Clemens Uniforms on W 5th Street in Lansdale, Pennsylvania.

Firefighters battled flames by rotating out putting water on the fire as it burned inside the large building, said Montgomery County dispatchers.

Crews finally got the fire under control around 4:30 a.m. Wednesday. The fire didn’t spread to any nearby buildings and no one was hurt, said dispatchers.

The cause of the fire – including if it was suspicious – remained under investigation Wednesday.

Clemens Uniforms has rented out uniforms since 1986 and has operated out of the 5th street location since 1988, according to the company’s website. No word yet on the impact of the blaze on the company’s customers.

'My Baby, My Baby:' NJ Mom

A Jersey City mother ran out of her house with her lifeless 2-year-old daughter in her arms Tuesday afternoon screaming, "My baby is dead," and prosecutors are investigating what caused the toddler to die.

"The lady came down screaming, 'My baby, my baby,'" neighbor Misty Machado recounted of seeing the woman run into the street just after noon.

"She rang my bell, she said 'call 911,'" said another neighbor, Chadita Peneiro. "I ran downstairs and as I opened the door, she threw the baby in my hand and the baby was extremely, extremely cold. And blue. The baby had foam coming out of the mouth, like it was having a seizure before it died."

"Purple -- her lips, her body, her back, everything. She was just lifeless," said Machado.

"I couldn't believe it. I'd never in my entire life ever seen nothing like that. And to see something like that -- I can't, I can't wrap my head around it," she said.

The mother told neighbors she put the girl to bed Monday night and woke up to find her lifeless just after noon Tuesday. But neighbors said they heard the child crying overnight.

Hudson County prosecutors would only confirm they're investigating the death of the 2-year-old girl in a home on Union Street between West Side and Mallory avenues. They did not release the names of the girl or her mother.

The girl's 4-year-old sister, who does not regularly live with them, had been visiting, neighbors said. The mother also has a son who does not live with her.

Neighbors say the mother and her stepsister moved into the home about a month ago. The neighbors say the women frequently appeared to be high, and there were often men visiting the home.

"All I know, it wasn't the right parent to be having the child," said Peneiro.

Neighbors frequently called police to complain when they saw the stepsisters exhibiting indecent behavior or acting aggressively toward their children. When police stormed the sisters' home Monday night for a report of some sort of break-in or robbery, Machado said she hoped she'd see them take the children out. But the little girls stayed.

"Several days I was worried and thinking something was going to happen," said Peneiro. "Now that the baby is gone, it's like, is there anything I could have done? Is there anything anybody could have done?"

The woman was detained at the scene and placed in the back of a police car, witnesses said, but it's not clear if she was arrested.

Peneiro said she saw the stepsisters digging a hole in the backyard in the early-morning hours two nights ago, and then covering it with a carpet. It's not clear if that's part of the investigation into the girl's death.

Messages were left with Jersey City police about whether authorities ever investigated the woman's home for previous complaints of child neglect or abuse.

Big Rig Blaze Backs Up I-95

A big rig blaze blocked Interstate 95 in Philadelphia during the Wednesday morning commute.

The tractor-trailer caught fire in the northbound lanes near Girard Avenue after 7 a.m.

Police blocked all northbound lanes of traffic as firefighters extinguished the blaze and cleanup crews cleared a corresponding fuel spill.

The roadway remained closed for about four hours, traffic snarled as vehicles were forced off at the Girard Exit and travel times on the 15-mile route from the Blue Route (I-476) to Vine Street Expressway (I-676) ballooned to 75 minutes or more.

As SkyForce10 hovered overhead you could see the red truck with a construction sign smashed into the front of it. No word yet on what caused the crash.

No one was hurt and the roadway reopened shortly after 11 a.m.

The I-95 fire wasn't the only one on area roadways causing traffic troubles Wednesday as a tanker caught fire in the inner northbound lanes south of Interchange 7A (I-195) in Hamilton Township causing all lanes to be blocked around 10:50 a.m.

Bystander's Submerged Car Rescue

A woman accidentally drove her vehicle into the Passaic River in New Jersey Tuesday morning, and police say she would have drowned if a man leaving a gym across the river didn't jump into action.

The 50-year-old woman from Cranford jumped a small curb on Dock Street in Nutley shortly after 8:30 a.m. and plunged into about 10 feet of water just north of the DeJessa Bridge.

Jason Moss was leaving the gym when someone ran past him, yelling for someone to call 911, he said. He quickly changed his clothes, dove into the murky water and brought the woman out of the submerged car, then carried her to shore.

"I think the scariest moment, I turned around at one point to see if there were any rescuers coming because I couldn't get the door open," the 30-year-old Moss told NBC 4 New York.

Emergency responders treated the woman and her rescuer on the scene, and transported the woman to a local hospital. She's expected to be OK.

The man, who's from Secaucus, refused a transport to the hospital, and went to an urgent care facility himself to get a tetanus shot, police said.

The car was pulled from the water by scuba teams and a towing company. Police are investigating what caused the woman to jump the curb.

Moss remains humble and said he wouldn't think twice about doing it again.

"It was more about doing the right thing," he said.
