New Theory in 'Boy in the Box' Cold Case

Two authors tell the NBC10 Investigators they believe they’ve solved one of Philadelphia’s oldest and most notorious cold cases.

On February 25, 1957 police discovered a young boy beaten, stuffed in a card board box and abandoned in the woods in the city’s Fox Chase neighborhood.

The boy was dubbed “the boy in the box.”  Today his grave reads “America’s Unknown Child.”

The details of the cold case chilled Philadelphia. Putting a name on the boy’s grave is something that frustrated generations of police investigators.

“To put a name on the child’s grave and to solve the case, it’s the ultimate in police work,” Philadelphia Police Sergeant Bob Kuhlmeier said.  

Kuhlmeier is the third generation of Philadelphia police detectives to lead the case.

In 1998, police exhumed the boy’s body and took a DNA sample from a remaining tooth.

The two authors – one from Los Angeles, and another from outside New York, say they believe they’ve traced the boy’s family to Memphis, Tennessee and need his DNA to prove it.

While researching separate books, they say they've paired two tips together: one from a woman claiming her mother bought and killed the boy; the other from a Philadelphia man who told the authors his family rented a home to a man who sold his son.

They took a DNA sample from who they believe to be the boy’s brother.

“The only way I’m going to find out if it’s the child is with the DNA evidence. Scientific evidence,” New Jersey based author Lou Romano said.

“It makes the most sense when you look at all the facts,” Los Angeles based author Jim Hoffman said.

Dr. Greg McDonald reviewed pictures of the boy, his potential brother and potential father.

McDonald is Philadelphia’s former assistant medical examiner and the current Montgomery County deputy medical examiner.

He said forensic experts will use pictures to judge if further laboratory analysis is required.

“There are some similarities to these pictures,” McDonald said. “Enough similarities that I think it’s worth further investigation through further laboratory tests.”

Dr. McDonald said the three men appear to share traits that could point to a genetic match.

Sgt. Kuhlmeier and his colleagues worked 280 homicides in 2015.  He said they have to work fresh cases first leaving little time to chase leads in a 59 year old cold case.  He called the author’s tip “average” and said before comparing any DNA police would need to confirm the timeline that led the authors to their conclusions.

“We’re going to investigate further is what we’re going to do,” Kuhlmeier said.

The car that hit and killed two teenagers and critically injured a third in New Jersey Saturday night was traveling 74 mph when it jumped a curb and slammed into the teens, police said.

The driver of the vehicle, 23-year-old Eric Patterson, faces two counts of death by auto and one count of assault by auto in the wreck on John F. Kennedy Boulevard on Union City that left 17-year-old Noel Herrera and 16-year-old Brian Rodriguez both dead and a third teen, 17, critically injured.

Patterson pleaded not guilty to the charges and is being held on $1 million bail. Attorney information for the man wasn't immediately available.

Authorities said that Patterson was driving with a suspended license at the time of the crash. Law enforcement sources told NBC 4 New York that toxicology tests were being performed because investigators had heard that Patterson had gotten into a fight with his girlfriend and may have taken drugs before getting behind the wheel.

Victor Sanchez, one of the bystanders who raced over to try to save the boys, told NBC 4 New York he pulled Patterson from his car after the crash.

"I smacked him across the head and tried to wake him, and dragged him out of the car. He was knocked out and didn't say one word to me at all," said Sanchez. 

The teens were walking home at about 9:15 p.m. Saturday when Patterson's car crossed over two lanes in a 25 mph zone, hit a curb and struck them on the sidewalk, surveillance video obtained by NBC 4 New York shows.

Herrera and Rodriguez were both pronounced dead at the scene. The third teen was taken to the hospital with multiple leg fractures and other injuries. He remained hospitalized and in stable condition Monday.

Evelyn Rogers heard the sound of the crash from indoors.

"There was a bang, like something hit," she said

When she came outside, she saw the boys on the ground, she said.

Sanchez said, "I'm traumatized. When I close my eyes, I could see these two kids dead on the ground." 

"He should be locked up. I'm sorry. A person who has a suspended license should not be on the road," he said of Patterson.  

At a vigil for Herrera and Rodriguez at the crash site Monday evening, family and friends released balloons into the sky and cried. One of the boys' mothers fainted and was taken to a hospital. 

Students said the school wasn't the same Monday. 

"Today at school, it's been really depressing," said Ismael Machado. "Everybody was sad, all our classes, it's been quiet." 

Authorities said they set up speeding checkpoints on the roadway Sunday and Monday, ticketing 38 drivers for going to fast. One motorist was traveling at 54 mph. 

Perdue Recalls Applegate Chicken Nuggets

Perdue Foods has recalled approximately 4,530 pounds of Applegate chicken nuggets that may be contaminated with plastic materials, according to the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS). The chicken nuggets were produced for Applegate Farms on Sept. 28, 2015.

The company is recalling 8-oz. boxed packages of Applegate Naturals Chicken Nuggets containing approximately 18 pieces with a best before date of Sept. 27, 2016.

The packages have the number “P-2617” inside the USDA mark of inspection. These items were shipped to retail distribution centers in Florida, Georgia, Indiana, Massachusetts, Pennsylvania, New York, and Texas.

Consumers complained of small, solid and clear plastic inside the Applegate Naturals Chicken Nuggets, according to USDA. 

Although there have been no confirmed reports of adverse reactions after consumption, anyone who may have concern for injury or illness should contact a healthcare provider.

Consumers should throw away the chicken nuggets, return them to the place of purchase or contact Applegate Consumer Relations with questions at 1-866-587-5858.

Dad Accused of Killing Son Appears in NJ Court

The South Jersey father accused of killing his 3-year-old and dumping the boy's body by the Cooper River last year appeared in court Monday morning.

David 'DJ' Creato Jr and his lawyers appeared in a Camden County courtroom for a status hearing. It wasn't immediately clear what was discussed in court Monday.

Creato has pleaded not guilty to murder and child endangerment charges stemming from the disappearance of his son Brendan.

Camden County prosecutors claim Creato killed his son because Brendan had become an impediment to Creato's relationship with a teenage girlfriend. They also say the girlfriend resented Creato's dealings with the boy's mother, with whom he shared custody.

The 22-year-old Haddon Township man was arrested earlier this year and remained jailed on $750,000 bail.

Brendan's body was found Oct. 13 in Cooper River Park about three hours after his father reported him missing from his Haddon Township home. Prosecutors have said the boy suffered "homicidal violence" akin to smothering or strangulation but haven't revealed more specific details.

A child was struck in a hit-and-run in the Olney section of Philadelphia, according to police.

Police say the 1-year-old child was on the 200 block of West Grange Avenue at 1:30 p.m. Monday when he or she was struck by a white van which fled the scene. The child was taken to the hospital and is currently in stable condition.

No arrests have been made. Police continue to investigate.

4 Hurt After Suspects Crash Into Several Vehicles: Police

Four people are fighting for their lives after suspects fleeing police crashed into several vehicles in West Philadelphia Monday afternoon, according to officials.

Officials say the incident began during a narcotics investigation in Darby, Pennsylvania. Two suspects related to that investigation fled in a rental car leading to a wild chase, according to police.

During the chase, the suspects entered West Philadelphia and crashed into several moving and parked vehicles along Cedar Avenue as well as Webster and 53rd streets, police said. The two suspects then got out of their vehicle and fled on foot, according to investigators.

Police say one of the suspects was immediately taken into custody. Another suspect allegedly ran into a nearby Laundromat however and changed clothes before hopping onto a SEPTA bus. Witnesses who saw the man change clothes alerted police and the suspect was apprehended, officials said. Police have not yet revealed the identities of the two suspects or the specific charges against them.

At least four people, including a 28-year-old woman and 30-year-old man, were injured after the suspects crashed into their vehicles, police said. The victims are all in critical condition.

Caught on Cam: Katt Williams Involved in Brawl During Philly Concert

New videos have surfaced showing comedian Katt Williams in an onstage brawl during a Philadelphia rap concert Sunday night.

The incident occurred during a concert and birthday celebration for Philly hip hop artist Beanie Sigel at the Trocadero Theatre on Arch Street. Chester native and hip hop producer Jahlil Beats as well as New York rapper Jadakiss also performed during the event.

In a video obtained by NBC10, Williams, 44, is seen charging and tackling a person on stage. He is then attacked by several men before bodyguards break up the fight. No one was arrested in connection to the incident, according to TMZ. During the same event, Williams was seen in other videos dancing wildly and randomly doing pushups. A witness who recorded the fight told NBC10 the comedian was acting erratically the entire night.

"He's in the back acting like he's driving a car," the witness said. "Everybody was like, 'What are you doing? Is this part of the show?' No it's not a part of the show so things like that are pretty abnormal. I can agree to say that." 

In another video posted on WorldStarHipHop(Warning: Explicit), Williams addresses "rumors" about the fight and claims that everyone he hit, "lost a piece of jewelry." 

Williams made headlines last month when he was arrested for allegedly punching an employee during an argument inside a Gainesville, Georgia pool supply store. He later claimed in a video obtained by TMZ that the employee called him the N-word.

Williams also insulted Philly comedian Kevin Hart during a recent comedy show, calling him a “puppet" and challenged him to a "comedy showdown." He later publicly apologized for his comments however.

Williams is a comedian and actor known for his roles in the films Friday After Next and Norbit as well as several standup comedy specials.
