No Charges Against Cosby in Playboy Mansion Case: DA

The Los Angeles County District Attorney's Office declined Wednesday to file criminal charges against comedian Bill Cosby over allegations he sexually assaulted a woman at the Playboy Mansion in 2008 and another allegation dating to 1965

Prosecutors cited the statute of limitations and insufficient  evidence in declining to file charges from the 2008 allegations. A lawsuit was filed Oct. 6 in federal court on behalf of the plaintiff, who claimed she was drugged and assaulted at the famed Playboy Mansion.

Cosby's attorneys said last year that the comedian was not at the mansion on the night of the alleged assault. Cosby's name did not appear on guest lists for mansion events in the summer of 2008, according to the district attorney's office. Cosby's name did appear on a guest list for a February 2008 event, according to the DA's office.

The accuser met early last year with Los Angeles police detectives, who forwarded the case to the district attorney for a decision on whether charges would be filed.

Prosecutors also announced Wednesday that they declined to pursue a case against Cosby over allegations he sexually assaulted a woman in the Hollywood Hills in 1965, when the woman was  17 years old. Prosecutors also said that case was barred due to the statute of  limitations.

The decision marked the second time the Los Angeles County District Attorney's Office has declined to  file charges against Cosby. In December 2014, prosecutors cited the statute  of limitations in declining to pursuing a case against the entertainer over  allegations that he sexually assaulted a 15-year-old girl at the Playboy  Mansion in 1974.

Cosby has been accused by dozens of women who claim the comedian drugged  and sexually assaulted them. He was charged with sexual assault last week in  Pennsylvania -- the first criminal charge filed against the comedian.

Cosby and his representatives have repeatedly denied all allegations.

Mom Faces DWI for Motel Wreck With Girl in Car

A South Jersey mother faces DWI charges after police say she smashed her sedan into the side of a motel, causing “significant damage.”

Bernadette McDaniels’ 4-year-old daughter was in the backseat the entire ride, said Egg Harbor Township Police.

McDaniels lost control of her 2009 Nissan Maxima as she drove east on Tilton Road around 11:30 a.m. Wednesday and wound up on the crossing over opposing traffic before slamming into the Rex Motel – across the street from the Wawa entrance near Idlewood Avenue.

The impact left the brick motel “structurally unsound,” said the township building inspector.

Officers found that McDaniels appeared to be impaired so she was arrested for multiple moving violations, child endangerment and drug possession.

A municipal judge arraigned McDaniels and sent her to Atlantic County jail in lieu of $5,000 bail.

No word on who is caring for the girl.

Parents of LOVE Park Wandering Toddler Face Eviction

After raising money to provide housing for the homeless parents of a toddler who was found wandering barefoot in LOVE Park last year, a Philadelphia ministry is close to evicting the couple.

“This couple doesn’t want change,” said Brian Jenkins of CHOSEN 300. “What they want is a free ride. And we’re all out of free rides. We’re interested in providing avenues to people that want to try to get up.”

Last October Mike Jones’ and Angelique Roland’s 2-year-old son Jeremiah was found wandering alone and barefoot in LOVE Park. Jones and Roland told police they had been kicked out of a home and had spent the night in a cardboard box near LOVE Park’s visitor’s center and Jeremiah had wandered off while they were sleeping.  Jeremiah as well as his 4-year-old sister were then placed in DHS custody.

After an outpouring of support from the public, CHOSEN 300, an inter-denominational Christian ministry that helps the homeless, launched a campaign to raise $12,000 to secure housing for the couple for one year. Yet barely 11 weeks into the lease, the group announced they had to end the commitment and evict the couple.

“Initially we were very optimistic to help the couple move ahead, however they rejected services and failed to comply with the judge's orders in which the children have not been returned,” CHOSEN 300 wrote in a press release. “Due to the uncooperative nature of the couple, but primarily due to the children not returning to the home, CHOSEN 300 ended the lease with the landlord on Jan 5, 2016 in which a 30 day notice was given to both the landlord as well as the couple. Mike and Angelique are now refusing to leave the property putting the landlord in a difficult situation."

Jenkins told NBC10 the couple ran up a $600 room service charge at a hotel before they got the house, missed a child custody hearing, resisted counseling and failed multiple drug tests.

Jones and Roland told NBC10 they attended court-ordered counseling but claimed 11 weeks wasn’t enough time for them to completely leave their life on the street behind.

“He doesn't realize there are steps people have to take,” Jones said. “Sometimes people bend a little bit. And you have to give a person time to right himself back up!”

Jenkins says the remainder of the $12,000 that was raised will go towards an educational account for Jeremiah and his sister. The children remain in DHS custody.

“We say to the public don’t lose hope,” Jenkins said. “Don’t hold your head down because one family decided that they didn’t want the help that we were there to offer. But there are other families out there who are desperate for our help!”

CHOSEN 300 says that if the court tells them Jones and Roland are ready to get back custody of their children and the only impediment is housing, they'll release the remaining funds but the couple must find a place to live. Jones and Roland told NBC10 they are trying to find an attorney who will represent them at no cost.

"He wants to sit here and make us feel like and look like we're the type of people where we want to be lazy or we've got a house and we're trying to lay back now," Roland said. "We're really not that type of people."

Three former prison guards are accused of running a “Fight Club” and forcing inmates to endure bizarre punishments, NBC News reported.

The trial in the case of Daniel Graff, David Whitcomb, Jr., and Mark Haynes got underway this week in York, Pennsylvania.

David Wright, a former inmate at York County Jail, named the three defendants among 11 prison guards in a civil complaint.

According to the complaint, inmates were forced to wrestle with each other, drink milk and consume cinnamon until they got sick, drink water with pepper foam and eat soups “that contained spoiled food and chemicals used for cleaning.”

All three deny the charges, according to PennLive, which is covering the trial.

Uber Black Drivers File Lawsuit Following Protest

Uber Black drivers filed a class action lawsuit against Uber Wednesday night following a protest in Southwest Philadelphia. The lawsuit, filed by Ali Razak of the Philadelphia Limo Association, an organization of over 500 Uber Black drivers, accuses Uber of failing to pay them compensation according to the requirements of the Fair Labor Standards Act.

READ: Uber Black Lawsuit

The lawsuit argues Uber has misclassified the Uber Black drivers as independent contractors rather than actual employees in order to avoid paying them wages, unemployment taxes, social security, workers' compensation premiums, disability taxes and other mandatory benefits.

Uber Black is marketed as the “luxury version” of UberX and features high-end luxury sedan vehicles.

Wednesday afternoon, dozens of Uber Black drivers protested at Uber’s Philadelphia headquarters on the 7800 block of Bartram Avenue around 2 p.m. calling for the ride-sharing service to lower its commission. The protesters also said they were upset they were forced to compete with UberX, which is a lower cost service.

“They are promoting UberX over us,” Razak said. “They’re blocking us. We have numerous riders complaining. We have information where they have blocked us and provided the jobs for UberX.”

The protesters listed the following demands in a written release:

1.     Uber must reduce the commission charged to drivers. We are demanding that Uber commission return to 20% instead of the inflated 25%. Uber has undercut the market with the illegal operation of UberX and Uber Black drivers can no longer afford the inflated 25%.

2.     Reset the customer app so that Uber Black is once again the default. We are already at a disadvantage because of UberX's cheaper rates.

3.     Fix the Uber Black function on the app; when a customer requests an Uber Black, it doesn’t appear on the app even though a vehicle is on location. The app is only showing illegal UberX vehicles.

4.     Fix the app so that it functions properly at the Airport. Currently the app stops when a driver has waited hours for a fare and is first up for the fare. Because the app freezes, drivers must go to the end of the line.

5.     Drivers' pay shall be calculated on the full fare, not readjusted later by Uber or customer request. If request is valid, drivers should be informed

6.     Stop telling Uber Black drivers to switch to UberX. We are stuck paying for luxury vehicles that you enticed us to through your partnered dealers and lenders. We cannot afford to pay car notes on luxury vehicles and feed our families on UberX rates.

7.     If customer used a hacked account after Uber released work to driver, then its Uber's responsibility, not drivers'. Drivers should not lose money after completing work approved by the app.

A spokesman for Uber responded to the protest with the following statement:

“While we understand that many limousine drivers are frustrated, Philadelphia has shown enormous appetite for more affordable options like UberX,” the spokesman wrote. “In Philly alone, more than 12,000 people are earning extra income through UberX, and nearly half a million riders use UberX to move safely from point A to B.”

The spokesman told NBC10 the company has taken several recent steps to promote Uber Black and increase demand, including purchasing ad space at 30th Street Station, in-app messages, and emails to Uber riders.

An Uber spokesperson also responded to Uber Black’s lawsuit in a written statement:

“Nearly 90 percent of drivers say the main reason they use Uber is because they love being their own boss.,” the spokesperson wrote. “Drivers are independent contractors who use Uber on their own terms; they control their use of the app.  As employees, drivers would lose the personal flexibility they value most -- they would have set shifts, earn a fixed hourly wage, and be unable to use other ride-sharing apps."

Mayor Kenney Calls for Change to Mummers Parade

$

Newly-elected Philadelphia Mayor Jim Kenney is calling for change to the Mummers Parade after the annual folk tradition was mired in a series of racist and homophobic acts along the parade route.

During the 116th annual parade Friday, "Wenches" from Finnegan New Year's Brigade, a local comic club, centered their act around Caitlyn Jenner's transition to a woman. In the performance for parade judges in the shadow of City Hall, a man dressed as Bruce Jenner dropped into a wheelchair and changed into a woman's costume while Aerosmith's "Dude Looks Like a Lady" played.

Behind him, group members held up signs showing Bruce Jenner on a Wheaties cereal box beside Caitlyn Jenner on a Fruit Loops box. The group later marched down Broad Street with the signs — some being held by young children.

Just south of Lombard Street, a Finnegan member was caught on video shouting "F--- the gays! F--- the gays!" at parade spectators. The man also posed for photos with the sign.

John Holtz, a gay man who was watching the parade, also claimed he was attacked by Mummers who were shouting homophobic slurs. Officers offered to take a report, but Holtz declined because he didn't want to ruin the rest of the day at the police station, he said.

The Sammar Strutters' "Siesta Fiesta" act also had the comics donning brown face and dressed in sombreros and ponchos. Some performers wore taco costumes.

A few Mummers carried signs reading "Mummers Lives Matter" and "Wenches Lives Matter" — a take on the national Black Lives Matter movement protesting police brutality and inequality.

Kenney, who blasted the Jenner act while responding to a tweet, told NBC10 Wednesday that the incidents at the parade offended not only Philadelphia but the rest of the world as well.

"The issue for me is -- the Mummers parade is such a Philadelphia thing and to have that kind of negative press -- in London and in Paris and in Spain and in Mexico -- it's just not good for the city," Kenney said.

Kenney's staff is considering changes ranging from sensitivity training to pre-screening Mummers acts.

"As you know, many of the Mummers just put on a great show for Philadelphia," said Rue Landau of the Philadelphia Commission on Human Relations. "It's the bad actors that everyone is concerned about, including the groups that are doing a good job."

City leaders say the Mummers organization must police its own parade going forward. Critics say the parade should be shut down for good if they don't.

"They either self-police themselves and we have accountability mechanisms in place that when they can't, either those troupes are shut down or we just finish it," said Erika Almiron, the Executive Director of Juntos. "We're done with it."

The Mummers apologized and condemned the actions that took place during the parade. They also announced the man shouting anti-gay comments in the video was removed from the group and banned from future parades. The group he was a part of also said they wanted to participate in LGBT fundraisers and events. The Mummers also said other members are being penalized for several violations.

"Those kinds of things are not tolerable," said George Badey, a Mummers spokesperson. "We want a parade that's family friendly. We want a parade that's going to attract more people to it."
