Dog Loses Toy in Shelter, But Gets Lucky With Rescue

Things weren't looking good for Needy, a loving 1-year-old mixed-breed dog who'd been living in a packed Philly-area animal shelter since November.

Even Needy's favorite toy, a teddy bear, was taken away from the dog. But just as Needy was running out of time in the crowded shelter, a rescue saved him just in the nick of time. Diamonds in the Ruff Rescue Team stepped in, rescuing the dog, whom they renamed Fozzie Bear.

Erica, who works with Diamonds in the Ruff Rescue, said that right before taking the pup from the shelter, the team had recently rescued another dog, Kermit, who passed away from health problems. So, to honor Kermit, they renamed Needy, “since Fozzie was Kermit’s best friend.”

Erica says Fozzie is adjusting well.

“He was a little bit shy in the beginning but now he is really opening up and really being sweet,” Erica said. "He got a new bone yesterday so he’s very happy.”

As for Fozzie's favorite teddy bear, Erica says the team posted about Fozzie needing one and received an outpouring of donations.

“Tons of people donated teddy bears, he’s going to have so many,” she said.

Now, people from all over the country have reached out to Diamonds in the Ruff about adopting Fozzie. Erica says each person was given an application, and the rescue league will carefully evaluate which home Fozzie would work best in. But first, he needs to be neutered and evaluated. This process could range anywhere from two weeks to a month.

“He’s doing so well,” Erica said. “He’s so happy, he can’t stop wagging his tail!”

Surge in Gun Violence Continues in West Philly

One man was dead and another was fighting to stay alive after separate shootings in West Philadelphia within minutes of each other Wednesday night.

In the first shooting, police said a man in his late 20s was shot once in the head by an unknown gunman on Redfield Street near Filbert, in West Philadelphia, just after 7:45 p.m. That victim, whose identity police said was unknown, was taken to Presbyterian Medical Center by responding officers. He was pronounced dead there at 9:29 p.m., police said.

No arrests were reported in that deadly shooting, which was the second fatal shooting on Redfield Street on Wednesday, after police said earlier in the day that a customer shot a car repairman to death on Redfield Street near Girard Avenue amid a dispute over work.

Less than 20 minutes after the shooting at Redfield and Filbert streets and less than a mile away, police were called to 60th and Manning streets, where authorities said another man was shot just after 8 p.m.

In that shooting, another man believed to be in his 20s was shot once in the head, police said. That victim, who was also unidentified later Wednesday, was taken Presbyterian Medical Center, where he was in extremely critical condition. Police said no arrests were made in that shooting, and it remained under investigation late Wednesday.

The back-to-back shootings came on the heels of a weekend of gunfire throughout West and Southwest Philadelphia that left several people wounded and a teenager dead.

Analyst: Technicality Could Put Cosby Evidence in Jeopardy

A legal analyst says procedural technicalities could give attorneys for Bill Cosby consideration to get the criminal charges filed against him Wednesday in a 2004 incident thrown out.

Attorney Enrique Latoison said he believes Cosby's attorneys will try to have incriminating testimony the comedian gave at a deposition in a civil case related to the alleged indecent assault of Andrea Constand thrown out.

The deposition, given after Constand filed a civil suit against Cosby and made public this summer when a judge unsealed documents in the case, is the evidence the Montgomery County District Attorney's Office used to charge Cosby with three second-degree felony counts of aggravated indecent assault.

Latoison said despite the fact that Cosby admitted to giving Constand pills and engaging in what he described as consensual sexual activity at his Elkins Park home, the Montgomery County DA's initial decision not to prosecute the case may make it more difficult for them to prosecute Cosby now.

"You have to remember he was under the impression that he was given immunity by the Montgomery County DA, and then he went forward and gave up his right to remain silent and testify at a deposition," Latoison said.

"If this would've been a criminal case, he would've probably not testified at all," Latoison later added.

At a news conference Wednesday morning announcing the charges against Cosby -- the first criminal charges to come out of accusations of similar sexual assaults by more than 50 women -- Montgomery County DA-Elect Kevin Steele said, "There's not a question of pills being provided to her. There's not a question of what went on of the digital penetration."

Cosby was arraigned Wednesday afternoon at a district court in Elkins Park and walked free after posting 10 percent of $1 million bail.

His attorneys called the charges against him unjustified and vowed to "mount a vigorous defense."

"We expect that Mr. Cosby will be exonerated by a court of law," attorney Monique Pressley, who is on Cosby's legal team, said.

If convicted, Cosby, now 78, could face up to 10 years in prison.

Suspect Shoots Self During Philly Home Invasion

A suspect shot himself in the leg during a home invasion in Philadelphia, police said.

The incident happened about 11 p.m. Wednesday in the 2500 block of N. Bancroft Street in North Philadelphia.

Investigators say two masked men entered the home and confronted a mother of two in the second floor of the home and demanded she empty her purse.

“In the next room are two children -- a seven-year-old boy and a three-year-old girl -- start crying. One of the perpetrators orders the woman ‘tell your children to stop crying’ and fires the gun,” said Chief Inspector Scott Small.

Small said the bullet struck the suspect in the leg. Both suspects then left the home.

A short time later, the suspect showed up at Penn Presbyterian Medical Center for treatment.

Hospital officials contacted police and the victim was brought to the hospital where she positively identified the suspect, Small said.

“The fact that he shot himself in the leg helped us apprehend him that much quicker,” Small explained.

The mother and her two children were not physically injured.

The second suspect remains on the loose.

A New Jersey gymnastics gym owner was arrested Tuesday on child pornography charges, authorities said.

Ronald Charles, 51, the owner of Freehold’s Galaxy Gymnastics, was charged with two counts of possession of child pornography. He was released after posting $40,000 bail, authorities said.

Detectives were led to Charles after a tip from the National Center for Missing and Exploited children, authorities said. Freehold police then obtained a search warrant for Charles’ apartment and computer and found child pornography images.

Judge Nicole Sonnenblick ordered Charles not to have any unsupervised contact with minors when he is out on bail, authorities said.

Shootings Leave 4 Dead in Violent Last Week of 2015

The last week of 2015 has been a violent one in Philadelphia, leaving at least four men dead in separate shootings around the city.

In the most recent in the spate of deadly shootings, gunfire in North Philadelphia claimed the life of a 21-year-old man early Thursday morning.

Police said the gunman remained at large Thursday afternoon.

Officers discovered the victim lying on Clearfield Street near 25th shortly after midnight when they received a 9-1-1 call, police said. The victim was taken to Temple University Hospital, but doctors were unable to save him, and he was pronounced dead there at 12:40 a.m. Police said he had been shot several times throughout his body.

The motive for the shooting was unknown late Thursday morning, and police continued to investigate.

According to police statistics, the New Year's Eve homicide was the city's 280th murder in 2015, marking a roughly 13 percent increase in homicides compared with both last year and the year before. Compared with 2012, however, when Philadelphia saw more than 300 homicides, the murder rate is down 15 percent for this year.

Police on Thursday also identified the victim in a deadly shooting in West Philadelphia's Carroll Park section that happened Wednesday afternoon. In that shooting, police said 57-year-old Seth Fassett, of the 200 block of South 45th Street, was shot to death at Girard Avenue and Redfield Street shortly after 2 p.m. during an argument over car-repair work he was doing. The alleged shooter, whom police said is a 39-year-old man, had not yet been arrested as of Thursday afternoon. Police said the shooting remained under investigation.

Elsewhere on Redfield Street in West Philadelphia on Wednesday, police said 23-year-old Naeem Garfield was shot to death just before 8 p.m. about two blocks from his home. Garfield, of the 300 block of North Redfield Street, was near the corner of Filbert Street when police say an unknown gunman shot him once in the head. He later died at Presbyterian Medical Center. Police said they don't know what motivated that shooting.

Another victim of deadly gun violence in the last week of 2015, who was shot dead in North Philadelphia on Tuesday night, was identified Thursday as 25-year-old Jeremy Rojas. Police said Rojas was on 8th Street near Ontario about 11:45 p.m. Tuesday when someone shot him several times.

Police found Rojas lying face-down on the street, picked him up and rushed him to Temple University Hospital, where he succumbed to his injuries and was pronounced dead at 12:08 a.m. Wednesday. Police said Rojas lived on Ontario Street about a block from where he was killed, and that they haven't yet determined who shot him or why.

On Way Out Door, Mayor Michael Nutter Wants to Cap I-95 in Philly

$

As Mayor Michael Nutter's mayoral term comes to a close, the outgoing city leader announced a $10 million study on capping Interstate 95 before admitting he is more prone to tears following his eight years in office.

"I think everybody has recognized, in the whole scheme of things, replacement of I-95 and the damage that its done to this city and a number of others is pretty clear," Nutter said at his final news conference Thursday.

With an unbuttoned collar and no tie, a casual Nutter said the study will be funded by state and federal dollars, although the city may end up contributing funds to the project in future budgets. The Federal Transportation Improvement Program has made a commitment to fund the first phase of the study.

The study, which will be done in conjunction with the Delaware Valley Regional Planning Commission, will focus on capping the area around Penn's Landing, including Columbus Boulevard, located near the Irish Memorial that sits just south of Front and Chestnut streets, the outgoing mayor said before he took a look back on his two terms.

"The fact is Philadelphia is safer today than before it was the day I became into office. The fact is there is more educational funding for schools than there has been at any other time," Nutter said. "The fact is unemployment has continued to go down and we are in a boom of economic revitalization. ... We’ve helped to change some of the culture around this government as far as corruption."

"Those are the facts," he said.
