Family Sues AC Casino for $30M After Deadly Crash

A Philadelphia mother wants $30 million from an Atlantic City casino that she claims put into action a series of events that left a little boy dead along the Atlantic City Expressway.

Shaina Davis-Holder claims that The Tropicana Casino ignored its legal and moral obligation on June 20, 2014.

“They need to own up they made a deadly mistake that cost my son his life,” a crying Davis-Holder told NBC10. “Because of Tropicana, instead of planning my son’s 5th birthday, I was planning his funeral.”

The Philadelphia woman wasn’t with her son, Syncere, at the time, having just started a new job.  Syncere was with relatives who were visiting the casino – having prepaid for four nights in the hotel – and some were admittedly drinking free drinks supplied by the casino when Trop workers told them to leave.

The boy and the five other family members got into a pickup truck, three in the front and three in the truck bed.

One hour later, Davis-Holder’s mother-in-law Roselyn Kornegay allegedly lost control of the pickup along the Atlantic City Expressway leaving Syncere and 35-year-old James Dennis dead. Kornegay, two teens and a 9-year-old child were injured.

Davis-Holder questions why the casino sent the family out of the complex instead of up to their hotel room.

“It wasn’t right, you ban them from the casino floor but you don’t kick them out of the hotel in the middle of the night with a 4-year-old,” said Davis-Holder. “They saw my son and they didn’t care, they saw that the driver was intoxicated.”

Attorney Raheem Watson filed suit on behalf of Davis-Holder and Syncere’s aunt and uncle -- Brian Gregory and Shaniqua Abrams -- seeking $30 million in damages. Watson said the casino accused the teenage relatives of underage gambling.

“Even if it was true, it doesn’t justify anyone – in this case a hotel and casino – from ejecting two intoxicated persons who had been gambling and drinking on the casino floor,” said Watson.

“They immediately kicked us out,” said Gregory, who admitted to underage drinking.

Watson said he believes race played a role in the casino removing his clients from the entire complex instead of just from the casino floor -- claiming that by law the casino couldn’t deny them resting in their hotel room.

The Trop didn’t respond to NBC10’s request for comment.

Kornegay faces DWI and death by auto charges. Witnesses said there were beer cans on the roadway after the crash.

Former Eagles Chuck Bednarik Dies

Philadelphia Eagles great Chuck Bednarik, a grisly pro football hall of famer and the namesake for one of college football's most prestigious awards, died early Saturday morning at a Pennsylvania assisted living facility at the age of 89, the Eagles announced.

Bednarik died around 4:30 a.m. Saturday following a brief illness, according to a release sent out by the team.

“With the passing of Chuck Bednarik, the Eagles and our fans have lost a legend. Philadelphia fans grow up expecting toughness, all-out effort and a workmanlike attitude from this team and so much of that image has its roots in the way Chuck played the game. He was a Hall of Famer, a champion and an all-time Eagle. Our thoughts are with his family and loved ones during this time," said Eagles Owner Jeffrey Lurie.

Bednarik was born in Bethlehem and played football for the University of Pennsylvania as well as the Eagles when he was chosen first overall in the 1949 NFL draft.

Bednarik, known as "Concrete Charlie," was one of the NFL's most fearsome tacklers and was one of of the NFL's last great two-way players. He played center and linebacker who's best known for two monumental hits during the 1960 season.

In one, in the 1960 title game, he threw a Green Bay Packers running back to the ground and refused to let him get back up as the final seconds ticked off the clock.

He's also known for his takedown of fellow hall of famer Frank Gifford earlier in the season. Gifford, a New York Giants running back, was hit so hard that he suffered a concussion and didn't play again for nearly two years. Enduring images of the tackle show Bednirak towering over Gifford and pumping his fist.

“So many of the timeless moments in Eagles history are associated with Chuck Bednarik. He played his entire career in Philadelphia, college and pro, and he lived his entire life here and in the Lehigh Valley. He was a proud competitor and a dedicated and devout family man who loved Eagles fans as much as they loved him. He left his mark on this team and will forever be a legend within this organization." said Eagles president Don Smolenski.

College football fans also remember Bednarik for the award that bears his name. The Maxwell Football Club have presented the Bednarik Award each year to the most outstanding defensive player at the collegiate level.

The Pro Football Hall of Fame linebacker leaves behind his wife of 67 years, five daughters, 10 grandchildren and one great-grandchild.

Family Plans 11K-Mile Trip to See Pope in Philly

An Argentine couple and their four children have already hit the road for a trip to Philadelphia for the World Meeting of Families next September.

That's an 11,184-mile journey -- in a Volkswagen van, according to the Catholic News Agency.

Noelle Zemborain and her husband Alfredo "Catire" Walker and their four children -- all under the age of 12 -- kicked off the seven-month trip earlier this month with the end goal being a celebration at the World Meeting of Families with Pope Francis -- a fellow Argentine.

"The family is everything and we want to say it," Zemborain told CNA.

The Zemborain/Walker clan were bid a fond farewell with a send-off mass in San Isidro in the Buenos Aires province on March 7. From there, they'll stop in Chili, up the Pacific Coast into Peru, Ecuador, Columbia, Central America and Mexico before making their way through the United States and, finally, to Philadelphia, " reported the News Agency.

Zemborain and Walker hope the trip will be a spiritual one designed to strengthen personal encounters and let go of material possessions, according to CNA.

Pope Francis is expected to arrive in Philadelphia Friday, Sept. 25 as the World Meeting of Families wraps.

11-Year-Old Girl Accidentally Shot in Philly

An 11-year-old girl is recovering after she was accidentally shot in the Wissinoming section of the city.

The girl was on the 6000 block of Charles Street Saturday at 4:49 p.m. when an unidentified person accidentally shot her, according to officials.

The girl suffered a graze wound to the head and was taken to St. Christopher’s Hospital. She is currently in stable condition.

Police are interviewing the girl's family to determine what exactly happened.

Body Found Floating in Delaware River

The body of a man was found floating in the Delaware River in the Bridesburg section of Philadelphia Saturday.

A visiting boat club found the unidentified man wearing a jacket and floating face down in the water behind the Bridesburg Recreation Center on the 3100 block of Buckius Street around 3:30 p.m. At first witnesses didn't realize they had found an actual person.

"They thought we may have put a mannequin in the water just to play a game with them," said Tom Flanagan of Philadelphia. "But it was a body." 

Officials have not yet identified the victim. They are working to determine a cause of death.

ATVs Confiscated During "Ride Out" for Meek Mill

Philadelphia Police seized dozens of ATVs and dirt bikes and arrested four people Saturday after riders took to the streets in preparation for a concert from local hip hop star Meek Mill.

Police told NBC10 they received word on social media that a "ride out" in honor of the 27-year-old rapper, born Robert Williams, was set to take place.  Meek grew up in Philadelphia and was active in the dirt bike riding community. His “Welcome Back” concert began at 8 p.m. Saturday at the Wells Fargo Center.

"We just got wind on social media that there might be a ride out for this concert," said Philadelphia Police Chief Inspector Dennis Wilson.

A citywide crackdown began at noon. The riders were spotted in North Philadelphia and Hunting Park throughout the day. Police told NBC10 they followed one group of riders who traveled from North Philadelphia to the Philadelphia Zoo before abandoning their vehicles and then running into a nearby garage. Police then took the vehicles without incident.

In all, police confiscated 68 dirt bikes and ATVs as well as three trucks.

"Two of the trucks were transporting stolen ATVs and dirt bikes," Wilson said. "Most of these seizures were a result of bikes that were trucked in. Some of these dirt bikes were just abandoned. The riders, when we closed in on them, jumped off and ran away."

In addition to the seized vehicles, police also made four arrests.

"One of the individuals we stopped had a gun on him," Wilson said. "He was arrested for the gun. Another individual had illegal drugs. Four of the bikes were stolen. We have two arrests on those bikes and I believe we have warrants in the pipeline for the other two individuals."

Wilson said the majority of the riders came from New York and Maryland and many did not know it was against the law to ride in the streets. 

"They were responding to what they saw on social media and they thought they were allowed to be part of the ride out, which of course was illegal," Wilson said.

One man whose vehicle was confiscated spoke to NBC10.

"We all heard about it from the same place, all over the media where everybody else heard it," said the man, who did not want to be identified. "No one actually knew it was illegal. We were just there to show a cause for children."

The man told NBC10 he hopes he can get his bike back so that he can get back to New York.

Both dirt bikes and ATVs are illegal on city streets. For years, police have tried to crack down on city dirt bike riders but are not allowed to pursue them due to a department policy which makes it illegal to chase a vehicle that's only committing a moving violation.

"It's extremely dangerous," Wilson said. "It causes auto accidents. There's always the possibility that we have individuals on the sidewalk that are gonna be hit by these dirt bikes."

Despite the fact that it's illegal, dirt bike and ATV riding in the streets is a popular activity in Philly, especially during the spring and summer months. Wilson still had a warning for riders however.

"When we catch you, we're gonna seize them," Wilson said. "You're not gonna be allowed to get them back."
