Woman Suspects Shovelers Were Racially Profiled

A local woman’s suggestion that two shovelers she hired to work on her sidewalk Tuesday were racially profiled by Lower Merion police has sparked an investigation.

Deborah Saldana of Penn Wynne, Pa., first shared her story Tuesday night in the Facebook group Lower Merion Community Network.

“We hired two kids to shovel our sidewalk,” Saldana wrote. “These were 'African American' kids (one is actually Haitian), that have come to our house and shoveled before.”

As they were shoveling, Saldana said two police officers stopped them behind her home and ran background checks on them while they sat outside in the cold.

“It just seemed wrong to have them sitting there,” she said. “They didn’t have weapons. They just had shovels sitting to the side.”

Saldana said her father went to check to see what was going on and was told by the officers they were conducting an investigation. The shovelers then went back to work after 20 minutes, according to Saldana.

“The cops came to the door to tell my father that from now on, 'anyone' shoveling in Lower Merion, except if it’s your own property, needs a permit from the township, a $50 permit that has to be valid if they check,” Saldana wrote. “We paid the kids and they were okay, a little shaken up. I wonder if the same would have happened it if was white kids shoveling?”

Saldana also told NBC10 she didn’t buy the officers’ explanation.

“I think it was profiling,” she said. “I hate to say it. I know we live in a really heated climate right now. I would like to think it was the permit. I think it was just a superficial excuse.”

Lower Merion police told NBC10 they are investigating the incident and have made numerous attempts to speak to Saldana but have not yet heard back from her. They also said based on their investigation so far, they made two stops in Penn Wynne at 11 a.m. and 2:40 p.m. for canvassing and soliciting. None of the people stopped were teenagers, according to Lower Merion Police Superintendent Michael McGrath.

“There were a total of five people in two incidents,” said McGrath. “Two gentlemen were in their 40s, two were in their 30s, and one of the 30-year-olds was accompanied by an 18-year-old. We’re not aware of any kids being stopped.”

No permit is required for kids to shovel in the Township, according to McGrath.

“We do want to make it very clear that kids can go out and make after-school money or day-off-from-school money,” he said.

McGrath told NBC10 the two officers involved in the stops are done with their shifts but will be interviewed when they return to work.

McGrath insisted that the reported stops had nothing to do with race and that both encounters were friendly.

“The officers were stopping them because they were soliciting for business in the neighborhood,” McGrath said. “We made stops for that 141 times last year in documented incidents because the township code requires anybody making any business-type solicitation to have a permit and give identification. This is something the community has requested for many years and it’s been on the books for decades... As far as them not being placed in police cars, that would be confining somebody when it wasn’t warranted in this case. When it came back that there may be an issue of a warrant, at that point those people were asked to sit on the curb until we resolved the issue. They were both cleared up. Nobody was arrested. Nobody was handcuffed.”

Saldana told NBC10 she doesn't know for sure whether the shovelers she hired are teenagers, even though she believes they are. Despite this, she also doesn't believe their age is the real issue.

"I've never seen any white kids stopped for their permit regardless of age," she said. "I still have to wonder. I don't jump to conclusions. I don't pass judgments very quickly. But it was just my gut instinct, because you never see anybody else stopped. So that's kind of the logical deduction."

City Maintenance Worker Charged in Trolley Assault

A city maintenance worker has been charged with beating a teenage girl on a SEPTA trolley last week after an argument over a book bag, authorities said.

Damon Oliver, 40, surrendered to investigators at Philadelphia Police's East Detective division on Wednesday morning, Philadelphia Police tell NBC10. He is a maintenance worker with the city's Department of Parks and Recreation, officials said.

Oliver was caught on surveillance video punching a 17-year-old girl named Shay in the face after an altercation on SEPTA's Route 17 trolley along Girard Avenue last Wednesday, police said.

Police and the girl said Oliver, who was sitting, was upset Shay's book bag hit him during the ride.

The teen suffered a broken nose and her eye was swollen shut.

Oliver is charged with Making Terroristic Threats, Simple Assault and Recklessly Endangering Another Person.

A spokesperson with the Department of Parks and Recreation said they were investigating and that it was too soon to say whether Oliver will be fired.

NBC10 obtained a copy of the affidavit Wednesday night which shows that police apprehended Oliver after a co-worker identified him as the man in the video.

The co-worker picked Oliver up a few blocks away from where he left the trolley after the assault, according to the affidavit. The co-worker told police Oliver had called him claiming he needed a ride because he was forced to jump off the trolley after a group of high school students attacked him.

A day later, the co-worker saw video of the attack on YouTube and recognized Oliver, according to the affidavit.

Neighbors told NBC10 Oliver has a daughter the same age as the victim.

"A coward," Oliver's neighbor Sheila Jones said. "That's all I can say. A coward. Any man that touches a girl is a coward."

Health officials will perform an autopsy to determine what took the life of a baby boy at a Delaware home day care Wednesday.

The 10-month-old, who has yet to be identified by police, was found unresponsive after an afternoon nap at Handy’s Little Disciples day care along the 28000 block of Laton Davis Road in Millsboro, Delaware, police said.

"The baby had stopped breathing," Bolarius Handy, husband of the day care's owner, told NBC10 on Thursday.

Employees called 911 and the baby was rushed to a hospital in nearby Lewes, Del. where he was pronounced dead, police said.

Handy called the death a tragedy. "Nobody did nothing, ya know, just she went to wake the baby up and [he] wasn't responsive," he said.

Police said there were no signs of injuries or trauma to the child. The state medical examiner will perform an autopsy to determine the cause of death. There's no timetable when those results may be released.

The home day care has been licensed by the state since 1998, records show. That license will now will suspended pending the outcome of the investigation into the baby's death. Officials said that's standard procedure.

NBC10 did reach out to the boy's family members, but have yet to hear back.

Small Plane Makes Emergency Landing on NJ Highway: Cops

No one was hurt when a single-engine plane made an emergency landing on a New Jersey highway Thursday after experiencing mechanical problems, authorities and the pilot said.

The pilot, identified as 51-year-old Christopher Okechukwu of Paramus, safely landed the Cessna C150 on Route 23 near Paradise and Doremus roads in West Milford around 1 p.m., police and federal officials said. Okechukwu was the only person on the plane.

No vehicles were hit during the emergency landing. Chopper 4 captured an extensive emergency presence at the scene as traffic slowed to a crawl behind the aircraft.

Okechukwu, a doctor who specializes in internal medicine, told NBC 4 New York he believes his carburetor iced up, triggering mechanical problems that made the engine run rough.

"I did what I was trained to do -- head for the nearest highway," Okechukwu said.

The doctor from Bergen County said he dodged a few overhead wires on the highway as he glided toward a potential landing place and eventually spotted an open stretch of the highway, behind a truck and car. He landed behind those vehicles, going with the flow of traffic, and caused minimal disruptions.

Okechukwu said Thursday was the first time he experienced such a problem in-flight and he was "a little shaken up." But the emergency landing wouldn't deter him from hitting the skies again, he said.

"I'll be back off. I love to fly," Okechukwu said.

The FAA is investigating.

Underground Fire, Potentially Lethal Gas Leak

Firefighters worked through the night to clear three commercial buildings in Norristown of carbon monoxide, which reached lethal levels in the properties after an underground fire caused a gas leak early Friday morning.

Crews responded to CO alarms that were going off in an AutoZone store on East Main Street, near Swede Street, around 1 a.m., officials said.

Initially they were unable to locate the cause, but an investigation uncovered an underground electrical fire involving PECO equipment led to the leak, according to Mike O'Donnell of the Norristown Fire Department.

The CO readings were so high -- 3,800 parts per million -- that O'Donnell said they were capable of killing a person in minutes.

"If they're inside the building, the levels we found could be lethal. They'd be dead," he said.

There was a risk of an explosion early on, but the firefighters brought in large fans to clear the gas out of the affected buildings -- 36 E. Main St., 40 E. Main St. and 48 E. Main St.

Online records show those addresses house Pauline's Deli, the law offices of Cullen and Conwell, and a temporary employment agency, Labor Ready.

A PECO underground utility crew headed to the scene to fix the leak at its source.

No injuries were reported.
