Ex-Philly Cop Faces Homicide Charge in Deadly Shooting

A former Philadelphia police officer faces a homicide charge for allegedly shooting an unarmed man in the back as he ran away from the officer last year.

Ryan Pownall is accused of killing dirt bike driver David Jones after pulling him over on June 8, 2017 along Whitaker Avenue in the city's Juniata section.

Philadelphia District Attorney Larry Krasner announced charges against Pownall on Tuesday after a grand jury presentment, the culmination of a yearlong investigation. Pownall is charged with criminal homicide, reckless endangerment and possession of a weapon of crime.

Pownall was fired from the police department following an internal review. He turned himself over to authorities on Tuesday. It's not immediately clear if he has retained legal counsel.

In the moments before the June 2017 shooting, Pownall was transporting three people to the department's Special Victim's Unit for an interview. Krasner said the officer pulled across traffic and into a parking lot after seeing Jones.

Pownall patted down Jones and felt a gun in his waistband, police said.

A witness in back of Pownall's police vehicle watched Pownall pull his service weapon and warn Jones not to touch the gun, police said. The two men then briefly scuffled as Jones turned his back on Pownall and fled, investigators said.

Pownall attempted to fire his service firearm, but it jammed, Krasner said. Jones, who was also armed, threw away his gun and ran in the opposite direction of the weapon, according to authorities.

Surveillance video obtained by NBC10 appears to show Jones running away when he was shot.

"Video recovered from the scene shows that Jones was unarmed and he never turned toward Pownall or gestured in a threatening manner during his (running away)," Krasner said. "As Jones ran, unarmed, Pownall fired at least three shots toward Jones and traffic, hitting Jones twice in the back."

The entire deadly interaction lasted less than 30 seconds.

"Jones' death was not necessary to secure the apprehension of Jones," Krasner said.

Last September, in the dismissal of Pownall from the department, Philadelphia Police Commissioner Richard Ross said the officer used poor judgment.

"Jones was running away from Pownall with nothing in his hands," Ross said.

Pownall broke department policy by making a traffic stop with witnesses in his vehicle, Ross said. Pownall also failed to notify police radio of the traffic stop or call for backup.

Several activist groups have held several demonstrations about the shooting, demanding answers in the case.

After a Black Lives Matter protest outside Pownall's home, the city police union president called the protesters a "pack of rabid animals."

Ross said some of the protests outside the officer's home were "out of bounds."

An arraignmentment for Pownall wasn't set as of Tuesday morning, Krasner said.

The Fraternal Order of Police is expected to comment on the charges Tuesday afternoon.

Philly Schools to Dismiss Early, Again, Due to Heat

Oppressive heat has forced the Philadelphia School District to dismiss classes early Wednesday, marking the fourth early dismissal already this year.

The district announced midday Tuesday that public schools will be dismissed Wednesday at noon and that all after-school activities, including athletic programs and professional development sessions, are also canceled. 

Class was held normally Tuesday despite temps pushing into the 90s with feels-like temps expected in the triple digits. The heat and humidity are expected to make it fell around 100 again on Wednesday and Thursday, the NBC10 First Alert Weather Team says.

The decision was made after students were dismissed early due to heat three times last week.

Some suburban schools, including Cheltenham High and Elkins Park schools in the Cheltenham School District, closed early Tuesday due to excessive heat.

Older school buildings without air conditioning can become stifling on oppressively hot days.

"Today is the day that the family of David Jones has been waiting for," said Isaac Gardner, one of the most visible protesters after Jones' shooting, said on behalf of his family. He added that they were excited for the charges, which they had not believed would happen.

According to police records, it was the second time Pownall was involved in an on-duty shooting where a suspect was struck in the back.

Carnell Williams-Carney was paralyzed in 2010 after Pownall and a second officer fired shots at him as he fled, hitting him once in the back. A federal jury ruled in a civil lawsuit that Pownall and the other officer were justified in opening fire.

Pownall was arraigned Tuesday afternoon and dneied bail, according to court records. A prelimary hearing was set for Sept. 19.

The Fraternal Order of Police called for the charges to be dropped and for Pownall to be reinstated on the force. They also called for Pownall to be allowed bail.

"FOP Lodge 5 and fellow officers stand in solidarity with Officer Pownall and his family," FOP President John McNesby said. "We promise a vigorous defense and expect Officer Pownall to be cleared of all charges and get his job back protecting the community."

‘They Have the Wrong Guy,' Attorney for Ambush Suspect Says

The defense attorney for one of three men charged in the ambush shooting of two Camden County police detectives last month had a message for the court during her client’s detention hearing Tuesday.

“What happened to these officers is horrible. Should never have happened,” Robin Lord said. “But he didn’t do it. They have the wrong guy.”

Lord’s client Juan Figueroa, 21, along with Ammar Hall, 26, and Alexander DeJesus, 19, are all charged with first-degree criminal attempted murder in connection to the shooting that occurred on Aug. 7 at Mt. Vernon Street and Broadway.

Police said two undercover Camden County officers were sitting at a red light when two men walked up and fired at least 10 rounds. One officer was hit in the hand and the other twice in the shoulder. The gunmen then fled the scene.

Both officers survived the shooting and continue to recover.

Dozens of police officers attended Figueroa’s detention hearing Wednesday. Figueroa was ordered to remain in jail without bail. Lord argued however that her client was innocent and claimed there was almost zero physical evidence to prove he was even there the night of the shooting.

“I don’t know how the warrant was even signed,” Lord said.

Prosecutors said however that Figueroa could be seen on numerous surveillance videos near and inside a white van connected to the crime.

“There is no amount of bail, nor any combination of bail in any other conditions that would both ensure that this defendant would show up, ensure that he would not obstruct and ensure the safety of the public,” Assistant Prosecutor Victoria Shilton said.

Figueroa does not have a history of violence. However, because police allegedly had to break down the door of a Gloucester City, New Jersey, hotel to arrest him last month, he’s considered a risk of flight. Camden County Superior Court Judge Edward McBride considered a number of factors in his decision to have him remain in jail without bail.

“Number one, potential for witness intimidation. Number two potential destruction of evidence,” Judge McBride said.

Figueroa could face life behind bars if convicted. His co-defendants DeJesus and Hall are awaiting extradition from Philadelphia.

Man Sexually Assaults Woman, Steals Her Car, Police Say

Police are searching for a man accused of sexually assaulting a woman inside her apartment in Newark, Delaware, and stealing her vehicle.

The 33-year-old woman told police she was inside the Hunters Crossing Apartments on Fairway Road Sunday around 5:30 a.m. when an unidentified man armed with a weapon forced his way inside her home.

The man then allegedly sexually assaulted the woman and stole her car keys before fleeing in her vehicle.

The suspect is described as a heavyset, dark skinned black male standing between 5-foot-10 and 6-feet.

The victim's stolen vehicle is described as a silver 2013 Honda CRV with the Pennsylvania license plate #KPP0923.

Hard Alcohol Will Soon Be Banned at Many Frats Nationwide

Many college fraternities nationwide will no longer be allowed to have some types of hard alcohol inside chapter houses or at parties, according to a new report.

The Chronicle of Higher Education reports The North-American Interfraternity Conference’s resolution has been approved and now its member fraternities, all 6,100 chapters on 800 campuses nationwide, must “adopt and implement a policy by September 1, 2019.”

The Chronicle added that new policy must prohibit “the presence of alcohol products above 15% ABV in any chapter facility or at any chapter event, except when served by a licensed third-party vendor.”

The new policy will prohibit most hard alcohol as most beer, wine and malt drinks are below a 15 percent alcohol level. The ban is planned to apply to Greek houses as well as students’ private living spaces.

The move comes on the heels of hazing and alcohol abuse among certain fraternities nationwide. At Penn State University, Beta Theta Pi pledge Tim Piazza of New Jersey died after a night of heavy drinking.

Piazza's father told USA Today the new policy is a "good start."

Report of Gun in Restroom Causes Philly High School Lockdown

A North Philadelphia high school was put on lockdown Wednesday morning after someone allegedly spotted a guy with a gun in a school restroom.

Thomas Edison High School on West Luzerne Street was put on lockdown around 9:25 a.m. after 911 received a call from school security about a report of an armed male.

No further description was given of the alleged armed suspect. Police vehicles could be seen on the sidewalk in front of the building.

No word yet if any threats were made or if anyone was hurt.

More than 1,000 students in ninth to 12th grade attend Edison High. The school, along with the rest of the Philadelphia public schools, is set to dismiss at noon Wednesday due to hot weather.
