Man Who Claimed Self-Defense in Neighbor Killing Charged

A Frankford man has been charged with two counts of murder for the shooting deaths of a neighbor and the neighbor's girlfriend July 16, the Philadelphia District Attorney's office said Friday.

Kenneth Hoyle, 69, initially told police he felt threatened by Bob DePaul and August Dempsey during an argument on James Street in the early morning hours. Police said Hoyle told them the two were climbing a fence into his yard when he shot them.

"After thoroughly investigating the incident, Kenneth Hoyle was charged today," a spokesman for the district attorney's office said in an email. "Look forward to providing justice for the victims’ family."

Residents later told NBC10 that the shooting deaths were the culmination of a long-running dispute between Hoyle and DePaul.

The incident occurred shortly before 2 a.m. on the 4700 block of James Street. Hoyle said he felt threatened and grabbed his gun. He then opened fire, shooting DePaul, 45, and Dempsey, 43. They both died from gunshot wounds to the head. 

Sources told NBC10 the 69-year-old man called police immediately after the shooting. He was taken initially into custody but later released. 

Residents say the man and DePaul were once friends but had been locked in an ongoing feud over the past few years. At one point the man even put up a wall between his porch and DePaul's.

“I know they didn’t get along,” Anna Szymanski told NBC10. “I don’t know why. But he was always nice to us.”

Dempsey, a mother of two, worked for the Philadelphia Parking Authority while DePaul, a father of four, was a maintenance worker.

Local U.S. Senators React to Dramatic Health Care Vote

Health care reform in the Republican-controlled Congress appears to possibly, maybe, perhaps be off the table for the time being in Washington, D.C.

The end to monthslong debate, first among the U.S. House, then among the Senate, came after a bill with relatively minor tinkering to the Affordable Care Act (aka Obamacare) failed to reach the 50 votes needed for passage in the Senate.

Three Republicans, 46 Democrats and two Independents voted against "the skinny repeal" bill.

Despite the failure of the seven-years-in-waiting "repeal and replace" vow by Republicans, Democrats are still bracing for more attempts later this year. Their cautiousness can be found in reaction by local Democratic senators after the vote. Here are statements by senators from Pennsylvania, New Jersey and Delaware.

Bob Menendez, D-N.J.:

"Tonight, millions of American families who rely on the affordable health coverage provided under the ACA can breathe a sigh of relief. And tonight, the hundreds of thousands of Americans who stood up, spoke out and demanded that politics be put aside should know that their power – the power of the people – proved stronger than the people in power. Tonight confirms the only way forward is to work together on behalf of all Americans. So, tomorrow, let’s get to work."

Tom Carper, D-Del.:

"In the words of Senator Schumer this evening, it’s time to turn the page. Tonight, we have the opportunity to change course and return to regular order, just as Senator McCain called for us to do when he returned to the Senate earlier this week. In the days ahead, we must immediately focus on stabilizing the exchanges. But then, we should fix the parts of the Affordable Care Act that need to be fixed and preserve the parts that should be preserved. We don’t need a Democratic victory, a Republican victory or a Trump victory. We need a victory for the American people. It’s now up to us – every single one of us – to prove to our constituents that we can do it. It’s what they expect from us and, more important, it’s what they deserve. Let’s get to work.”

Pat Toomey, R-Pa.:

"I am disappointed with this setback on efforts to fix our broken health care system. For the hundreds of thousands of Pennsylvanians suffering from the higher costs and fewer choices caused by Obamacare’s collapse, Congress must not give up on repealing and replacing the failed health care law."

Cory Booker, D-N.J.:

"Tonight is a victory for the millions of Americans who will not lose health coverage because Senate Republicans failed to pass their latest disgraceful attempt at a health repeal bill. This is also a victory for the thousands upon thousands of Americans across the country who rallied, marched, and called their Senator to demand the right to affordable, quality health care. Your voices were heard. Tonight’s failed vote is a testament to your power – the power of the people, which we all know is greater than the people in power. In the United States, it shouldn’t matter how much money you make or where you live – you should have access to quality, affordable health care, because health care is a human right. The fight isn’t over. Republicans in both chambers have made it clear they’ll stop at nothing to enact their dangerous agenda. If we don’t stop them, they'll strip health coverage from millions of Americans, raise premiums, and gut protections for people with pre-existing conditions. We must remain vigilant and continue speaking up and out against those who would prefer to play politics with the nation’s health care system rather than earnestly work to improve it."

Bob Casey, D-Pa.:

“The Senate Republican scheme was a terrible bill for the middle class and that’s why it was rejected on a bipartisan basis. It’s now time for Democrats and Republicans to work together on common sense solutions that will make our health care system more affordable and bring down costs for families. I commend Senator McCain for his courageous vote.”

Officer Turns Scary Attack Into Joy for Delco Boy

Damian Faust was peddling his way to meet his friends in Aldan Tuesday evening when a man on a bike rode up next to him.

The man asked if he could ride the 12-year-old’s wheels. When Faust said no, the encounter turned dangerous.

“He said ‘If you don’t give me that bike, I’m gonna have to shoot you,’” the boy told NBC10 Friday.

Faust said when he objected again, the man pushed him to the ground and rode away with both bikes.

The police were called and when Aldan police officer Chris Izzi showed up, he could tell Faust was pretty shaken up. He wrote a police report, learning that the boy had saved up money to buy the bike on his own.

“I’m a father of four children. I have a child Damian’s age. I just felt so bad for him. I couldn’t imagine if it happened to my child,” Izzi said.

Izzi decided to turn the scary and disappointing encounter around. On Wednesday, he showed up at Faust’s home in nearby Clifton Heights with a surprise: a brand-new Mongoose bike.

“He said ‘Go get your mom’ and I ran in screaming ‘He bought me a bike,” Faust said. “I was really happy.”

Damian’s mom, Sandy Luciani, said she started crying over the kind gesture.

“I was in tears because all you hear is negativity about police officers,” Luciani said.

Izzi said it was just an opportunity to give back to the community.

“No child should have to go through this. They should be able to go out and ride their bikes and not fear for their safety,” he said.

Child Struck by Freight Train Behind Delco Hotel

A child was struck by a freight train in Tinicum Township Friday evening, police said.

The incident happened around 5:45 p.m. at 76 Industrial Highway near the Clarion Hotel. The hotel is just south of Philadelphia International Airport.

Tinicum police Sgt. James Simpkins said the 8-year-old resident had their leg run over by the freight train between Wanamaker Avenue and the Darby Creek Bridge.

The child was taken to nearby Crozer-Chester Medical Center. The injuries were described as serious, but the child's condition was not immediately known.

A neighbor said kids sometimes play by the tracks and another man pointed out a piece of missing fence around a neighborhood skate park that can be used to gain access to the rail lines.

Freight train operator Conrail's police department is investigating, Simpkins said.

Philadelphia Man Killed by Lightning on Florida Beach

A Philadelphia man has died after he and another man were struck by lightning as they walked along a Central Florida beach.

Brevard County Sheriff's Office officer Tod Goodyear said the men were hit around 5:30 p.m. Friday as they walked in a group along the A1A beach in Satellite Beach, Florida. The beach is along the Atlantic coast about an hour's drive east of Orlando.

Lamar Rayfield, 35, of Philadelphia, died from the injuries he sustained, Goodyear said.

NBC affiliate WESH2 reported an off-duty lifeguard and a passerby performed CPR on Rayfield for several minutes as they waited for paramedics to arrive.

Rayfield died at the hospital, officials said.

The other man, who has not been identified, remains hospitalized, but is expected to recover.

Heavy rain, as expected, left flooding conditions along shore points early Saturday.

NBC10’s Ted Greenberg found flooding at Ventnor and Washington avenues in Margate, New Jersey before daybreak Saturday after an evening of heavy downpours. Streets flooded along the Jersey Shore including intersections in Avalon, North Wildwood, Sea Isle City, Strathmere and other towns before daybreak Saturday.

The standing water began to recede in Margate Saturday morning, leaving some cars abandoned on drying out roads.

The heavy rain hit as far west and north as Philadelphia and the immediate suburbs. But, this was a true case of neighborhood weather as no measurable rain fell in Allentown in the Lehigh Valley Saturday.

Plenty of rain, however fell, at shore points – more than 5.8 inches at Atlantic City International Airport, more than 5 inches in Wildwood Crest, nearly 5 inches in Cape May and more than 2.5 inches in Millville, New Jersey.

Less than half an inch of rain fell in Philadelphia and Wilmington. But nearly 4 inches fell near Reading, Pennsylvania and more than 5 inches fell near Milford, Delaware.

By 7 a.m., rain had stopped in some neighbors that had heavy downpours overnight as drier air pushed the system out to sea. The shore could see spotty showers through the day.

The weather Sunday should be less humid and nice with highs in the lower 80s, NBC10 First Alert Weather meteorologist Krystal Klei says.

Child, 4, Dies in South Jersey House Fire

A 4-year-old girl died in a "chaotic" row home fire in Camden, New Jersey overnight, family members confirmed.

Flames tore through the home on Morton Street near Louis Street just after midnight Saturday with five or six people inside,

A young girl died in the fire. Other children and adults in the home were able to escape the flames and smoke but did suffer injuries, firefighters said.

Family members and witnesses said that residents threw children from a second-floor window to help them escape.

"It was chaotic when the companies arrived," Camden Fire Chief Michael Harper said.

The home had working smoke detectors.

No word yet on what caused the deadly blaze but Harper said there is no reason to suspect anything suspicious.

Deadly Stabbing Inside Center City Homeless Shelter

A man was stabbed to death inside a Philadelphia homeless shelter Saturday morning, authorities said.

Medics pronounced the man dead at about 9:30 a.m. Saturday inside the Sunday Breakfast Rescue Mission at N 13th and Pearl streets in Center City, Philadelphia police said. He had multiple stab wounds.

Investigators took a suspect into custody, recovered a weapon at the scene and interviewed about 40 witnesses to the stabbing, police said.

The shelter serves three meals daily to anyone in need and also offers a men’s shelter and long-term recovery program, the Christian faith-based mission says on its website.

The mission still hopes to carry out plans to serve lunch -- possibly serving sandwiches in the parking lot -- and dinner Saturday, even though the building remains a crime scene.

"Sunday Breakfast Rescue Mission has ministered to the physical and spiritual needs of the homeless and disadvantaged in the Philadelphia area since 1878," SBRM says.

An employee for the mission declined comment Saturday morning.

New 'Super' Wawa Opens in Delco

Delaware County has a new "super" Wawa.

Delco Councilman Dave White and District Attorney Jack Whelan joined the celebration at the grand opening of the convenience store’s new location at Baltimore Avenue, Providence Road and State Street in the county seat of Media, Pennsylvania Friday.

The new store features more than just hoagies – it has gas pumps to fuel up at and outdoor seating to eat that Shorti.

As part of the Grand Opening, Wawa presented a $2,500 check to Delco Interfaith Food Assistance Network (DIFAN), through Delco’s Family & Community Service and Department of Human Services, which provides food assistance to families.

Man Dies From Shooting in Delco Town, Possible Shooter Fled

A man died after he took at least one bullet to the chest Saturday evening inside an apartment in normally quiet Haverford Township, and a possible gunman was seen fleeing toward nearby Lower Merion, police and witnesses said.

The unidentifed victim, who one neighbor described as a man with a goatee, was rushed to a nearby hospital as paramedics performed CPR on him outside the row of two-story apartment buildings at 2315 Haverford Avenue.

He died a short time later at the hospital.

Detectives cordoned off one of the pathways through the stone-sided buildings and a man believed to be a friend of the victim remained outside shortly after the gunfire erupted about 6:15 p.m.

A man that two witnesses said was in a red hoodie ran from the apartments toward Merion Road. It was not immediately known if he was captured by police.

Brian Hoffman, whose backyard is along a shared alley with the rear of the apartments, was helping his next-door neighbor put some mulch down when he heard the two gunshots. He called 9-1-1.

"We thought at first it was fireworks," Hoffman said. "But then I said, 'I think that's gunshots."

He said some yelling followed the gunfire, which he said sounded like it came from the second floor of the apartment building.

"I couldn't make out what they were saying," he said. "It was two men yelling."

The shooting shocked him.

"It's not something you expect around here," he said. "We called it a day with the yardwork."
