Wrongly Convicted Man to Be Free After 24 Years

A Philadelphia man imprisoned for nearly a quarter century for a crime he did not commit will soon be free.

Philadelphia Common Pleas Judge Rosemarie DeFino-Nastasi vacated Shaurn Thomas’ conviction and sentence Tuesday, paving the way for his release within the next 24 hours.

In 1994, a jury convicted Thomas of murder in the 1990 killing of Domingo Martinez that happened when Thomas was just 16 years old. He was sentenced to life in prison.

Thomas and his mother, Hazeline Thomas, insisted Thomas was elsewhere at the time of the killing, according to a news release from the Pennsylvania Innocence Project and Dechert law firm, which worked pro bono on the case.

"Shaurn engaged in a decades’ long struggle to prove his innocence," attorney James Figorski said. "I joined him in that struggle, and many times it seemed that we would never succeed and he would remain in prison for the rest of his life."

Authorities threw out the conviction in 2015 after a witness admitted to lying about Thomas' role in the killing.

His mother said Thomas fought every day in prison to clear his name.

"I'm proud because ... he was innocent and he did something about it," she said.

"It is gratifying to know that we were able to help Shaurn Thomas obtain his freedom after witnessing the injustice to which he was subjected," Figorski said. "All of us are ecstatic that Shaurn Thomas will finally be free with his family."

The Philadelphia's District Attorney's Office has until a June 13 hearing to decide if they plan on retrying Thomas.

While they couldn't get back the last 24 years of Thomas’ life, his legal team was glad to give the now 43-year-old a future.

"We are so grateful to our partners in righting this terrible injustice," said Marissa Bluestine, legal director of the Pennsylvania Innocence Project.

"Dechert has been a champion for Shaurn, with the team tirelessly working on finding the truth and proving him innocent. We are all so overwhelmed by this result. While we cannot get back the last quarter century of his life for Shaurn, we can give him a future."

Montco Company Manages Arena Targeted by Terror

The company that manages the British arena where a suicide bomber killed and wounded people leaving an Ariana Grande concert Monday night is based in Montgomery County.

SMG, which has its world headquarters in Conshohocken, Pennsylvania, released a statement about Monday night’s incident at Manchester Arena that left 22 dead, including children, and 59 injured:

"On Monday evening at approximately 10:30 p.m. (BST) an incident occurred in a public space outside of Manchester Arena as attendees were exiting the Ariana Grande concert. Arena management continues to assist law enforcement officials in their investigation. Any questions should be directed to the Manchester Police Department. Our thoughts and prayers go out to the victims and their families of this tragic incident."

The Manchester Arena is one of dozens of properties in the United States — including Philadelphia’s Pennsylvania Convention Center; Reading, Pennsylvania’s Santander Arena; Bethlehem, Pennsylvania’s Sands Bethlehem Event Center and the Wildwoods Convention Center — Europe and the Caribbean managed by SMG.

"The fact that they hit a concert I think is more coincidental," said international security expert, author and Rutgers political science associate professor Wojtek Wolfe. "There are so many soft targets out there." 

That doesn’t mean that larger venues aren’t taking security measures, like pat-downs and metal detectors, to prevent any weapons from getting inside. Attackers, however, can target people outside the security perimeter.

"What you're seeing both in the West and the Middle East is ... more and more bombers targeting outside the perimeter," Wolfe said.

No one at SMG or other Philadelphia-based event management companies would comment about specific security measures. AN SMG spokesman did pointed out that the bombing occurred outside the arena in a public space.

Wolfe said that the likelihood of a venue being attacked is "very slim." But there are measures you can take to ensure you are ready in case of an emergency.

"It's always important to practice situational awareness," Wolfe said. "Always know the details of the event that you are going to, always have an emergency plan of where you are going to meet people in your party if they get separated and always have a backup and alternative."

Live Nation, which operates various Philadelphia venues said in a statement, "We are deeply saddened by this senseless tragedy and our hearts and thoughts are with those impacted by this devastating incident."

6 Days of Free Fun for Wawa Welcome America

Singer Mary J. Blige, Philly legends Boyz II Men, the Philly POPS and fireworks highlight Philadelphia’s FREE Independence Day celebration — but there is so much more to the 2017 Wawa Welcome America festival.

Philadelphia Mayor Jim Kenney joined other city officials and folks from the beloved convenience store chain Tuesday to announce 50 free events over six days this summer.

The Wawa Welcome America July 4th Concert and Fireworks features Blige – the queen of Hip-Hop soul — Boyz II Men, Kidz Bop and the Philly POPS Big Band for the Party on the Parkway.

The family-friendly festivities get underway at 1 p.m. at the foot of the Philadelphia Museum of Art. Families can enjoy “the Strider Bikes obstacle course, zip line, games, and make-and-take arts and crafts,” organizers said. [[420037303, C]]

The main event gets going at 7 p.m. and features the POPS, joined by Hamilton actress Mandy Gonzalez and pianist Tony DeSare, along with a ceremony honoring Boyz II Men. Blige then headlines in what is her only free show on her “Strength of a Woman” tour. There will be beer gardens for the 21+ crowd and various food and music on the Philly Groove side stage. There is even the Amtrak Pet Friendly Area where you can bring your furry friends.

The night wraps up with two patriotic (and simultaneous) fireworks show at 9:30 p.m. over the art museum and over the Delaware River sponsored by NBCUniversal and Pyrotecnico.

The Party on the Parkway will air live on NBC10, NBC10.com and Telmundo62 on July 4th. NBC10 and Telemundo62 are official partners of Wawa Welcome America.

Before the parkway party, there will the Celebration of Freedom Ceremony in front of Independence Hall in Old City at 10 a.m. The city will recognize the music and philanthropy of Boyz II Men. The Philly POPS Big Band will also play. Mayor Kenney will present the Magis Award to Philadelphia Hometown Hero Ralph Galati. "Galati’s service has been honored with The Silver Star, The Bronze Star with Valor with one Oak Leaf Cluster, The Air Medal with four Oak Leaf Cluster, The Air Force Commendation Medal with two Oak Leaf Cluster and The Purple Heart with one Oak Leaf Cluster,” organizers said. You can also see the presentation of the Wawa Foundation Hero Award.

Following the Independence Hall ceremony, the Independence Day Parade featuring 4,000 marchers will parade through historic Philadelphia.

Other free events in Old City on July 4 include the Let Freedom Ring Ceremony (1 p.m.) where the Liberty Bell will be tapped; the 6th Annual Birthday Party at the Independence Visitor Center (9 a.m.) hosted by Betsy Ross and Termini Bros. Bakery, featuring a massive cake in the shape of the American Flag; and a children’s naturalization ceremony (1:30 p.m.) where 13 children will become citizens at the Betsy Ross House.

The Independence Day Festivities are all part of the theme of the 25th-annual festival, “Everyone Is a History Maker.”

The festivities begin with a 6-ton hoagie salute at Wawa Hoagie Day at the National Constitution Center on Thursday, June 29 from noon to 2 p.m.

This year’s festival includes Culture on Tap, a pop-up beer garden in the City Hall Courtyard on June 29 from 4 to 9 p.m. and the Food Trust's Night Market Spruce Hill: Independence Day Weekend Edition at 40th & Walnut Streets from 6 to 10 p.m. in West Philly.

Free museum days and nights at the movies return for this year’s festival.

Other events include fireworks shows on at 9:30 p.m. on June 30 and July 1 that will be visible at spots along the Delaware River and SugarHouse Casino’s Red, White & Brew event geared toward 21-and-over millennials on July 1.

NJ Transit Line to Be Diverted During Penn Station Overhaul

All New Jersey Transit's Morris & Essex Midtown Direct trains to Penn Station will be diverted to Hoboken during the weeks-long overhaul at Penn Station this summer, Gov. Christie announced Tuesday. 

The Morris & Essex Line's Midtown Direct trains will end in Hoboken, and from there, PATH trains and ferries will honor NJ Transit fares on that line, Christie said at a news conference Tuesday.

"Amtrak is telling us now that the eight-week repair schedule that will begin in July and run to Labor Day weekend will necessitate limited service into Penn Station for the Morris & Essex line of the Midtown Direct line, and that will obviously cause some significant delays," Christie said. 

It's the only line that will be affected during the work in July and August, Christie said. NJ Transit riders on other lines won't be cross-honored on the PATH or ferry.

Morris & Essex riders will get a discount of 56 to 63 percent during the work -- so a monthly pass from Gladstone to New York City, for example, would drop from $451 to $168, and still include the free ferry and PATH transfers.

Christie estimates a loss of revenue to New Jersey at about $15 million.

"I'm not happy about any of this, but the fact of the matter is, we're gonna either make these repairs now or make them later," he said. "But the repairs need to be made." 

Daily ridership numbers on the Morris & Essex Midtown Direct line were not immediately available. 

Amtrak, the owner and landlord of Penn Station, announced earlier in the month that it's finally getting around to fixing tracks and switches that have been crumbling for years. The overhaul will cut down service for both NJ Transit and LIRR commuters for six weeks.

In New York, Gov. Cuomo was presenting his own plan for Long Island Rail Road commuters who are expected to be detoured from Penn Station during the makeover project.

Alternatives will include a high-speed ferry service, several park-and-ride sites along the Long Island Expressway, and free buses from Nassau and Suffolk. 

Both Christie and Cuomo have called for a private operator to take over Penn Station, blaming "decades of underinvestment" by Amtrak for a "continuing string of infrastructure failures at Penn Station."

$5K Reward for Arrest in Shooting That Injured Dad, Toddler

A manhunt is underway after two men on BMX bikes opened fire on a 26-year-old father and his 2-year-old son Friday night. Police are now offering a $5,000 reward. 

Philadelphia police rushed to the scene on the 3300 block of Malta Street upon reports of a young child shot in the city's Kensington neighborhood on Friday around 9:15 p.m.

Police say the toddler was shot four times in the back and his father was shot in the knee after the suspects said, "This is our block."

The child was taken to St. Christopher's Hospital, his father to Temple Hospital. Both victims are now in stable condition.

Both shooters fled on their bikes after the shooting and were last seen on Westmoreland Street. Police released surveillance video of the suspects Tuesday.

The first suspect is described as a black male standing 6-foot-3 in his 20s with braids and weighing 220 pounds. He was last seen wearing a black shirt, riding on a bicycle and carrying a duffel bag or book bag. The second suspect is described as a black male in his 20s standing 5-foot-11 and wearing a light shirt and riding a bicycle.

President John McNesby announced that the Philadelphia Lodge 5 Fraternal Order of Police is offering a reward of $5,000 for information leading to the arrest of the person or people responsible for the shooting.

2 Abington Cops Honored for Disarming Armed Man

When Abington police Officer Gary Martinez arrived to a call for a suicidal man one evening last September, he found a distraught man in the middle of the street.

He tried talking to the man to calm him down, and while it wasn't enough to completely subdue him, it was enough to stall the man until backup arrived. That was Sgt. Oswaldo Toledo.

Within moment's of Toledo's arrival, the man allegedly pulled a .38-caliber revolver and "a life-and-death struggle ensued." Toledo fought with the suspect and was able to discharge the gun's five bullets harmlessly into the ground.

With no more rounds to shoot, the man was subdued by the two cops.

For their valor under fear of death, Martinez and Toledo were honored Tuesday at the 36th annual Citizens Crime Commission luncheon in Philadelphia. They were two of 26 officers from South Jersey and southeastern Pennsylvania who received awards, including four officers shot in the line of duty in 2016. Those officers are Philadelphia Sgt. Sylvia Young and Officer Jesse Hartnett, Atlantic City Officer Joshlee Vadell and Folcroft Officer Christopher Dorman.

Two civilians, both residents of Philadelphia, were also honored for bravery in separate incidents that involved chasing down alleged robbery suspects and holding them until police arrived.

The commission, which runs a tips hotline and gives out rewards for information that leads to convictions, held the awards luncheon at The Bellevue Philadelphia on South Broad Street in Center City.

GIF Mobile App Names Philly the Saddest City in America

Cheer up Philly! According to a new study, the city of brotherly love is the saddest city in America.

The mobile app Tenor celebrated the 30th anniversary of the Graphics Interchange Format, better known as GIF, by creating a breakdown of the most popular emotions and images among the top 10 U.S. markets based on GIF search behavior.

While “Wow” was most popular in Chicago and “Wink” in Los Angeles, Philadelphia’s top search was for the “Cry” GIF, according to Tenor. We’re guessing the recent struggles of the city’s major sports teams may have had something to do with Philadelphians feeling blue.

Still, the findings should be taken with a grain of salt. Any study that claims New Yorkers are “happy” can’t be completely trusted.

Gunman Kills Man, Injures Man and Woman in East Germantown

A gunman killed a man and injured a woman and another man in the East Germantown section of Philadelphia early Tuesday evening.

A 37-year-old man, 26-year-old man and a 29-year-old woman were both on the 5500 block of Heiskell Street at 5:21 p.m. when a gunman opened fire. The 37-year-old man was struck once in the chest, the 26-year-old man twice in the lower back and the woman once in the right leg.

All three victims were taken to the Einstein Medical Center. The 37-year-old man was pronounced dead at 6:12 p.m. The 26-year-old man and the woman are both in stable condition.

Investigators say at least two suspects wearing all black jumped into a black SUV and drove off after the shooting. No arrests have been made.

Philly Buddhist Center Finds Permanent Home After 25 Years

After an estimated 25 years of leasing space for worship, the Chenrezig Tibetan Buddhist Center of Philadelphia finally bought a one-story fixer-upper for $225,000, NBC News reported.

In February, after completing renovations paid for in part through fundraising, the center finally opened the doors to its own spiritual home. 

"What my hope is, is that having the physical location we'll be able to open and really attract people who didn't know it was here but need that kind of centering space," outgoing center president Sara Jacoby told NBC News.

Kennett Square Rallies Around Dad Facing Deportation

The fate of a Guatemalan immigrant with ties to Kennett Square hanged in the balance Tuesday as local officials decided whether he will be deported or allowed to remain in the country.

Earlier this month, police pulled over Hever Puac Domingo and his family during a traffic stop in Lancaster County. Domingo disclosed his immigration status and was arrested in front of a family member. The car was impounded and the family left to make their own way home, said Kennett Square pastor Juan Carlos Navarro on Facebook.

Domingo was sent to a detention center in York County while Navarro helped pick up the family's car. He was charged $425, he said on social media.

"The 6-year-old girl cried and begged me to help 'daddy return home,'" Navarro wrote.

Lawyers for the family do not know why he was stopped in the first place. 

“We have had clients tell us that they were pulled over for no reason at all,” immigration lawyer Anna Paciorek said. “There is a lot of racial profiling going on.”

Domingo’s journey started four years ago when he crossed into the United States without documentation. Fleeing poverty and violence in his native country, he was stopped at the border by immigration officials and received an expedited removal order, Paciorek said.

Despite the order, Domingo settled in Chester County with his wife and two daughters. He is the sole guardian of his younger brother, who is applying for permanent residency. One of his children is a U.S. citizen and one is a student in the Kennett Consolidated School District.

Domingo has no criminal record.

Early Monday morning, he boarded a plane headed to the U.S.- Mexico border, where he was to be deported out of the country. Philadelphia lawyers intervened on his behalf and issued a stay of removal. He was returned to York County Prison pending a review of his case.

In the meantime, Paciorek’s firm waged a campaign to keep Domingo in the U.S. Sympathetic community members have flooded Immigration and Customs Enforcement with phone calls and emails asking officials to not separate the family. The law firm credits these efforts with Domingo’s return to Pennsylvania after his narrow brush with deportation.

A vigil is planned in his honor Friday, May 26, at the First Baptist Church in Kennett Square.

Police are investigating dozens of vehicle break-ins that have occurred in Tredyffrin Township, Chester County within the last eight weeks. The break-ins occurred on the following days at the following locations:

  • March 16-17: Four break-ins in the Strafford section of Tredyffrin Township

  • April 7-8: Three break-ins occurred on Thomas Road
  • April 27-28: Ten break-ins occurred in the Valley Forge Estates section of Wayne that borders the Valley Forge National Park
  • April 30-May 1: One break-in reported in the VF Estates section on Gen. Scott Road
  • May 2-May 3: Two break-ins reported on Prussian Lane
  • May 12-May 13: Three reported break-ins on Coldstream Drive
  • May 19-May 20: Sixteen reported break-ins in the Valley Forges Estates section of Tredyffrin Township on Von Steuben, Prussian, Anthony Wayne, Thomas, Brookmead and Sullivan roads 

Investigators say only 2 of the 61 vehicles that were broken into were locked and entered by force. They estimated total loss, not including damage from two broken windows, to be approximately $2,500. They also say during most of the thefts, money was visible inside the vehicles. During some of the thefts, sunglasses, brief cases, checkbooks and wallets were stolen.
