Write-In Candidate Pulls Off Stunner in Philly Election

Democratic write-in candidate Emilio Vazquez pulled off a surprise victory in a North Philadelphia special election to replace disgraced state Rep. Leslie Acosta, who gave up her seat following a corruption conviction.

His victory was announced Friday morning after the city Election Board hand tallied all 2,483 write-in votes.

Vazquez became an improbable winner in a race that saw the Democrat originally slated for the ballot knocked off following a residency challenge.

That left only Republican candidate Lucinda Little on the ballot for a district -- the 197th -- that is 85 percent Democrat and 5 percent Republican. Little received only 198 votes on Tuesday.

The write-in votes were tallied in about three hours by election workers for the Philadelphia City Commissioners.

Vazquez received 1,964 votes, followed by Cheri Honkola, who received 280 votes, Deputy Commissioner Tim Dowling said.

Another 120 or so votes were "scattered" among other people, Dowling said.

All of the ballots cast will be preserved for any potential legal challenges, which candidates Little and Honkola have voiced as a possibility.

Leaders of the Pennsylvania Republican Party even gathered to call into question the results. A day after the special election, a group of Republicans called for the state attorney general to investigate what they alleged were violations of the election code and irregularities during the voting.

Meanwhile, Latino leaders in the community expressed their own concern for a process that led to a special election without a Democrat on the ballot.

“It just continues to substantiate why voters in that district have earned the right to be cynical. The 197th has made national news as a symbol of the Democratic party’s weakness," Israel Colon, former director of the city’s multicultural office during Mayor Michael Nutter’s tenure, told NBC10 this week. "What is happening in this sector of the Latino community is nothing more than a microcosm of an antiquated Democratic party in our city that has lost its way -- only concerned with preserving its power and its own existence.”

Editor's note: Earlier version of this story reported Emilio Vazquez's name as Vasquez.

A Woodside, Delaware, woman has been charged with trying to smuggle heroin and marijuana into the James T. Vaughn Correctional Center during a visit.

Ashley M. Everett, 32, was arrested Wednesday and charged with two counts of possession with intent to deliver a controlled substance, two counts of promoting prison contraband and possession of drug paraphernalia, Delaware state police said.

Police said Everett entered the visiting area of the correctional center to visit an inmate. A correctional officer told Everett she would be searched for any contraband. Everett became emotional, and after officers searched her they allegedly found .084 grams of raw heroin and 3.52 grams of marijuana in a bag inside her mouth.

Cherie Amoore Guilty of Kidnapping Baby From KOP Mall

Cherie Amoore, the 33-year-old Merion woman who last year stole a baby from the King of Prussia mall, was found guilty of kidnapping and concealment of a child in a Norristown courtroom Friday.

Accompanied by lawyer, Marc Steinberg, Amoore took the stand in front of Judge William R. Carpenter to accept a guilty verdict in a stipulated bench trial, by which she gave up her right to a jury trial and to testify in her own defense.

Prosecutors described Amoore as "trolling the King of Prussia mall" on March 31, 2016 – striking up conversations with at least two mothers who were there with newborn baby boys – before grabbing 7-week-old Ahsir Simmons at the food court and running out with him.

The prosecution say the action was the culmination of an elaborate scheme that involved Amore pretending she was pregnant and holding a baby shower before the kidnapping, and introducing the infant to her family members as her own afterwards.

Neither Amoore nor her lawyer offered comment at the verdict.

Amore is free on bail, pending sentencing. The prosecution has indicated that at sentencing they will request that Amore serve years behind bars.

Monsignor William Lynn to be Retried

A Catholic church official's 14-year legal odyssey over his handling of sex-abuse complaints won't end anytime soon after a Philadelphia judge said Friday he would be retried on child endangerment charges.

Monsignor William Lynn had served nearly three years of a three- to six-year sentence when the Pennsylvania Supreme Court tossed his conviction because of trial errors. That was the second time Lynn's conviction had been thrown out after a sweeping 2012 trial that unearthed decades of hidden complaints from locked vaults at the archdiocese.

Lynn, 66, appeared weary but unfazed after the ruling Friday. He will be back in court next week for the judge to decide how many church-abuse victims can testify at the retrial. His lawyers could also appeal and try again to have the case dismissed.

Philadelphia District Attorney Seth Williams — who revived the case after his predecessor reluctantly concluded no church leaders could be charged in 2005 — is in his last year of office and under federal indictment. Eight people are running to succeed him.

"They can't dismiss the case. Hundreds of thousands, perhaps millions, of dollars were spent investigating the archdiocese and prosecuting Lynn, so what's the next prosecutor going to do?" asked defense lawyer Jeffrey Lindy, who represented Lynn for a decade, but is no longer involved in the case. "They're not going to say, 'OK, we proved our point, let's go away.'"

Lynn could also seek a plea with a time-served sentence, although he has not been interested in plea negotiations in the past.

Lynn is accused of endangering a single altar boy, a city policeman's son who testified that he was abused in about 1998 by a priest transferred to his parish. Lynn, the longtime secretary for clergy, had reviewed 50 years' worth of secret files to prepare a list of problem priests. He labeled the one in question, William Avery, a suspected predator. Lynn told jurors he made the list to try to address the problem, only to have Cardinal Anthony Bevilacqua have it destroyed. Bevilacqua, excoriated in two grand jury reports, was never charged.

Lynn's lawyers call him a scapegoat for the archdiocese.

After years of twists and turns in his case, the defense recently accused prosecutors of hiding exculpatory evidence that some investigators felt the altar boy, who battled years of heroin abuse, was not credible. He testified that he was molested by two priests and a Catholic school teacher — and all three, including Avery, were convicted.

An independent psychiatrist in 2015 concluded his accounts were so inconsistent it was impossible to know if he had ever been sexually abused, according to a defense motion. The evaluation came as part of the young man's lawsuit against the archdiocese, which was settled after the criminal trials for an undisclosed sum.

Philadelphia Common Pleas Judge Gwendolyn Bright refused to dismiss the case over that issue, but invited an appeal before she sets a trial date. The defense will weigh the option..

Williams, who is accused of taking more than $100,000 in gifts in exchange for official favors, remains in office.

If the case is retried, Bright wants fewer than a dozen church-abuse victims to testify. The first trial featured 23 such witnesses, providing weeks of testimony the appeals court later called unfair to Lynn.

Periods of Rain Stretch Across Several Days

$
0
0

Pennsylvania, Delaware and New Jersey fall under a rainy period over the next several days. This period isn’t a constant, widespread rain. Instead, it’s a spottier on-again, off-again forecast that will last through Tuesday.

Warm Saturday

A large storm system has been driving across the country, and is forcing warm air our direction ahead of the cold front that crosses through the Midwest Saturday morning. With a southwest flow, temperatures began mild Saturday and will continue warmer than average into the afternoon. Temperatures are forecast to hit the low 70 over portions of Philadelphia and areas south, such as South Jersey and Delaware.

Through the afternoon, a surface cold front will slip to the south and a few disturbances in the atmosphere will ripple across our region. This will allow for continued periods of light and spotty rain into the evening. As the front passes overnight (called a backdoor front when it passes from the north/northeast), a brief period of more widespread light rain is possible. Overall, Saturday will still be a great day to get outdoors.

Cooler, Damp Sunday

Temperatures will fall Saturday night as the frontal passage allows winds to shift from a southwest flow, to a more easterly push. When winds come from the east, they pick up the cool air characteristics off the ocean water. The winds will also strengthen, bringing breezy gusts up to around 25 mph to the region. The cold front passage also allows colder air to spill into the area from the north. This will result in very little warming through the entire day. From low to mid 40s in the morning to only upper 40s for many in the afternoon Sunday.

Light spotty showers pass Sunday morning, especially north. Along the Poconos, some brief freezing rain may occur. The rest of the day will be damp and mostly cloudy, with continued showers developing late day into the night as the storm system that was to the west begins to near the Delaware Valley. Take a look at the picture below for Sunday evening. The storm center is still to the northwest, but the area of rain is beginning to move in (green).

Best Days for Rain

The best day for rain comes Monday, as the system actually passes across the region. The best chance of rain will be north and west of Philadelphia, but most areas should see at least some scattered showers. The rain will be steadiest in the morning, and scattered through the later day and night.

At the same time, yet another rainy system moves in from the west. You can see the center near Missouri and Illinois:

Like Monday, Tuesday will see periods of more widespread rain. Again, the showers will be scattered and light to start in the morning. Through the early afternoon the area of rain may expand across the area, and linger into the early evening. This will mostly be light showers, as the green on the map below is light in color without pockets of yellow or orange (heavier activity indicator).

By Wednesday morning, the moisture should move out and we’ll see several days of dry and sunnier conditions. Temperatures remain Spring-like, hovering around the 50s and 60s during the work week. Another wet period is possible by the weekend, more on that in the days to come!
